The City of Heath Board of Zoning and Building Appeals will conduct a public hearing on Tuesday, November 18, 2025 at 6:30 PM at the Municipal Building, 1287 Hebron Road Heath, Ohio to review the following request for Building and Zoning variances:
Case # 22-2025 (1347 Bluejack Ln/030-119028-00.008)
Laura Ware, property owner and owner of Ware Bakes, is requesting a use variance to Chapter 1161.03 (d) of the City of Heath Codified Ordinances for conditional uses in the R-1 Single Family District which states that “The following uses are permitted as conditional uses when authorized by the Board of Zoning Appeals: Customary home occupations, such as handicrafts, dressmaking, millinery, laundry, preserving and home cooking; provided that such occupations shall be conducted exclusively by resident occupants, that not more than one-quarter of the area of one floor of such residence shall be used for such purpose, that no structural alterations involving features not customarily found in dwellings are required, and that entrance to the space devoted to such use shall be from within the dwelling. An unlighted sign of not over one square foot in area and attached flat against the building shall be permitted.”
Ms. Ware would like to do “porch pop-ups” from her residence located at River Oaks which would be a small set up on her porch or driveway, where she would have her products available for purchase.
Case # 23-2025 (744 Francis Dr./030-088062-00.057)
Nicholas LoPrinzi, agent/applicant, for Fischer Homes is requesting a variance to Chapter 1157.06 of the City of Heath Codified Ordinances for rear yard setback of a minimum of 50 feet. The variance has been requested to change these requirements for rear setback from 50 feet down to 49.5 feet to allow placement of a new deck with the new build home.
Case # 24-2025 (1306 Kacey Ct./030-088062-00.052)
Nicholas LoPrinzi, agent/applicant, for Fischer Homes is requesting a variance to Chapter 1157.06 of the City of Heath Codified Ordinances for rear yard setback of a minimum of 50 feet. Case # 25-2025 (605 Heath Rd./030-088188-00.001)
Randy Blackledge, property owner, is requesting an appeal to a violation received on October 8, 2025 to the City of Heath Codified Ordinance, Section 1175.05. This section of the ordinance expressly prohibits the establishment, maintenance, or use of any dwelling unit or residential occupancy on property zoned M-2 Heavy Manufacturing. The zoning designation for 605 Heath Road is M-2; therefore, residential use of the property is strictly prohibited.
