MORTGAGEE’S NOTICE OF SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain Mortgage given by Linda Lundgren to Mortgage Electronic Registration Systems, Inc., as nominee for LOANDEPOT.COM, LLC, its successors and assigns, dated December 29, 2016 and recorded with the Worcester County (Worcester District) Registry of Deeds at Book 56550, Page 266, as affected by Affidavit recorded with said Registry of Deeds in Book 70005 at Page 53, subsequently assigned to Fifth Third Bank, National Association by Mortgage Electronic Registration Systems, Inc., as nominee for LOANDEPOT.COM, LLC, its successors and assigns by assignment recorded in said Worcester County (Worcester District) Registry of Deeds at Book 63053, Page 314 for breach of the conditions of said Mortgage and for the purpose of foreclosing same will be sold at Public Auction at 2:00 PM on November 18, 2025 at 11 Oakridge Drive, a/k/a 11 Oak Ridge Drive, Charlton, MA, all and singular the premises described in said Mortgage, to wit:
PARCEL 1: The land with the buildings thereon, located on Acorn Lane, also known as Sore Drive, on Prindle Lake, Charlton, Worcester County, Massachusetts, which is shown on a Plan of Property, Subdivision North Section, Prindle Lake Company, Charlton, Mass., March 15, 1965 John C. Miller, Reg. L.S., Charlton, Mass., recorded in the Worcester District Registry of Deeds in Plan Book 291, Plan 75 and more particularly bounded and described as follows:
BEGINNING at an iron pin in the northeasterly corner of lot #3 as shown on said plan on the westerly side of road as shown on said plan and being the southeasterly corner of lot #4 as on said plan;
THENCE N. 87 deg. 01' 12" W. a distance of 107.17 feet to an iron pin at the edge of the high-water mark in Prindle Pond;
THENCE N. 87 deg. 01' 12" W. a distance of 25 feet more or less into Prindle Pond to a point in Prindle Pond;
THENCE Northerly by line parallel to the westerly edge of the Pond a distance of 100 feet more or less to a point in Prindle Pond;
THENCE N. 89 deg. 52' 27" E. a distance of 111.21 feet to an iron pin in the ground at the westerly side line of the aforesaid road at the northeasterly corner of said lot #4 as shown on said plan;
THENCE S. 27 deg. 05' 33" W. a distance of 100.0 feet by the westerly line of said road to the iron pin at the point of beginning.
This parcel contains lot #4 as shown on said plan and a twenty-five (25) foot wide strip in Prindle Pond extending out from the aforesaid lot #4.
Subject to rights of way over all of the roads shown on said plan, and with the rights to use the waters of Prindle Lake.
Subject to Declaration of Restrictions and Covenants executed July 26, 1965 and recorded in Book 4591, Page 358.
PARCEL 2: The land in Charlton, Worcester County, Massachusetts, situated on a private road near Prindle Pond and being shown as Lot #3 on a plan entitled "Plot Plan of Property, Subdivision North Section, Prindle Lake Company, Charlton, Mass., March 15, 1965, John C. Miller, Reg. L.S., Charlton, Mass., and more particularly bounded and described as follows:
BEGINNING at an iron pin in the ground on the westerly side of the aforesaid private road, said iron pin being distant fifty-one (51) feet from a cement bound on the westerly side of the aforesaid private road, measured from the cement bound to the iron pin, North 27 deg. 05' 33" East;
THENCE N. 27 deg. 05' 33" E. by said road a distance of one hundred (100) feet to a point at lot 4 on said plan;
THENCE N. 87 deg. 01' 12" W. a distance of one hundred seven and seventeen hundredths (107.17) feet to an iron pin near the shore of Prindle Lake;
THENCE S. 26 deg. 49' 05" W. a distance of one hundred (100) feet more or less to an iron pin;
THENCE N. 88 deg. 13' 57" E. a distance of one hundred twelve and forty-eight hundredths (112.48) feet to the iron pin at the point of beginning.
Said premises are conveyed subject to "Declaration of Restrictions and Covenants Executed July 26, 1965 and recorded with Worcester District Registry of Deeds, August 17, 1965, which restrictions and covenants by the acceptance of this deed the Grantees hereby accept.
Together with the right to use the aforesaid private way for access to the premises from Prindle Hill Road and together with the right to use the waters of Prindle Lake.
The premises are to be sold subject to and with the benefit of all easements, restrictions, encroachments, building and zoning laws, liens, unpaid taxes, tax titles, water bills, municipal liens and assessments, rights of tenants and parties in possession, and attorney’s fees and costs.
TERMS OF SALE:
A deposit of TEN THOUSAND DOLLARS AND 00 CENTS ($10,000.00) in the form of a certified check, bank treasurer’s check or money order will be required to be delivered at or before the time the bid is offered. The successful bidder will be required to execute a Foreclosure Sale Agreement immediately after the close of the bidding. The balance of the purchase price shall be paid within thirty (30) days from the sale date in the form of a certified check, bank treasurer’s check or other check satisfactory to Mortgagee’s attorney. The Mortgagee reserves the right to bid at the sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney. The description of the premises contained in said mortgage shall control in the event of an error in this publication. TIME WILL BE OF THE ESSENCE.
