NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Stephen A. Innis, Cheryl A. Innis to Preferred Mortgage Group, Inc., dated February 23, 2005 and recorded in the Middlesex County (Southern District) Registry of Deeds in Book 44709, Page 385, of which mortgage the undersigned is the present holder, by assignment from:
Preferred Mortgage Group, Inc. to Mortgage Electronic Registration Systems, Inc., its successors and assigns, as nominee for The Huntington National Bank, its successors and assigns, recorded on February 28, 2005, in Book No. 44709, at Page 400 Mortgage Electronic Registration Systems, Inc. to The Huntington National Bank, recorded on April 3, 2012, in Book No. 58821, at Page 377 for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at 11:00 AM on November 26, 2025, on the mortgaged premises located at 9 Capri Drive, Framingham, Middlesex County, Massachusetts, all and singular the premises described in said mortgage,
TO WIT:
The land in Framingham, Middlesex County, Massachusetts, with the buildings thereon, being shown as Lot numbered 8 on a plan entitled "Subdivision of Land in Framingham, Mass., Owned by Richard M. Wyman", dated May 28, 1962, MacCarthy Engineering Service Inc., recorded with Middlesex South District Registry of Deeds as Plan No. 94 of 1963, Book 10205, Page 206, being more particularly bounded and described as follows:
Southwesterly by Capri Drive, on three courses, forming a curve and together measuring 103.11 feet;
Northerly by Lot numbered 9 on said Plan, 133.31 feet;
Easterly by Lot numbered 4 on said Plan, 89059 feet; and
Southerly by Lots numbered 6 and 7 on said Plan, 179.08 feet.
Containing according to said Plan, 13,730 square feet of land.
The premises are conveyed subject to an Easement tot the New England Tel. & Tel. Co. recorded with said District Deeds in Book 10305, Page 240.
The premises are conveyed also subject to Protective Covenants recorded with said District Deeds in Book 10226, Page 535.
For mortgagor's(s') title see deed recorded with Middlesex County (Southern District) Registry of Deeds in Book 30693, Page 562.
These premises will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
TERMS OF SALE:
A deposit of Fifteen Thousand ($15,000.00) Dollars by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at Harmon Law Offices, P.C., 150 California St., Newton, Massachusetts 02458, or by mail to P.O. Box 610389, Newton Highlands, Massachusetts 02461-0389, within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. The description of the premises contained in said mortgage shall control in the event of an error in this publication.
