CHANCERY SALE
Pursuant to that certain September 29, 2025 Order entered by Part VI of the Davidson County Chancery Court, at Nashville, Tennessee, in the case of ServisFirst Bank v. Charles Picasso, et. al., Case No. 25-1050-IV, notice is hereby given that I, as the Davidson County, Tennessee Clerk & Master ("Clerk & Master"), will sell at public auction at the front door of the Historic Metro Courthouse located at 1 Public Square, Nashville, Tennessee 37201, at 12:00 PM CST on November 21, 2025, the real property commonly known as and located at 4333 Eatons Creek Road, Nashville, Davidson County, Tennessee 37218 (the "Property"), pursuant to the Plaintiff's lien thereon as set forth in that certain Deed of Trust of record at Instrument Number 20220412-0042003, Davidson County, Tennessee Register of Deeds, as may have been modified, amended and/or restated from time to time (the "Deed of Trust"), said Property more particularly described, as follows:

Being part of Lot No. 1 of Exhibit A on the Plan of the Subdivision of the lands of Dr. J.B. Jordan, deceased, as of record in Plan Book 2, page 75, Chancery Court at Nashville and described as follows: Beginning in the center of Eatons Creek at the NE corner of said Lot No. 1; thence with the center of said creek, S 06°37'W 68.5 feet; S 32°10'E 85.8 feet; S 57°21'E 98.6 feet; S 88°36'E 132.8 feet; N 83°04'E 82.7 feet; S 51°26'E 66.8 feet and S 06°07'E 255.7 feet to an iron pin; thence S 87°44'W 67.5 feet to an iron pin; thence S 87°10'W 486.5 feet; thence N 27°48'W 205.3 feet to an iron pin; thence N 10°30'W 343.5 feet; thence S 88°30'E 301 feet to the beginning, containing 5.67 acres, more or less, according to a survey made by Nickerson-Miller, Engineers-Surveyors, dated 05/30/1956.
Being the same property conveyed to CHARLES PICASSO AND ISABELLE PICASSO, HUSBAND AND WIFE, by deed from LOYD F. POTTS, of record in Instrument No. 20210927-0129248, dated September 22, 2021, said Register's Office.
Terms of Sale:
All right of homestead, equity of redemption, statutory right of redemption, and all other rights and exemptions of every kind, including but not limited to any statutory right to an elective share in the Property, are expressly waived in the said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as its authority as Clerk & Master without representation or warranty.
This is a real and personal property foreclosure employing the provisions of Tennessee Code Annotated Section 47-9-604(b)(2).
The terms of sale shall be by open bidding with a minimum starting bid in an amount to be furnished to the Clerk & Master by Plaintiff no later than one (1) week prior to the sale date. Plaintiff may credit bid to the amount of its lien. In the event the Plaintiff is the winning bidder with its credit bid, Plaintiff shall pay outstanding court costs and costs of the sale, including but not limited to any commissions, Clerk & Master expenses, publication expenses, marketing fees, and like expenses prior to confirmation of the sale. Otherwise, the property shall be sold to the highest bidder above Plaintiff's credit bid and if any such bidder presents the winning bid at the sale, such winning bidder shall be obligated to execute a contract for the sale of the Property, which contract shall require 20% of the winning bid to be immediately payable in good and certified funds as non-refundable earnest money, and the sale shall close within twenty-one (21) days of the foreclosure sale, but subject to final Court approval, including approval of the issuance of a Chancellor's Order, Chancellor's Deed, or other appropriate recordable instrument conveying the Property. If the winning bidder fails to close or to execute a sale contract, the sale will proceed to the next-highest bidder, and so on, but all subject to final Court approval, as above. Any winning bidder shall take title to the Property subject to applicable taxes and any other liens or encumbrances superior to Plaintiff's lien, including, but not limited to, any unpaid ad valorem (property) taxes or other taxes, and also subject to the right of redemption of the Internal Revenue Service, if any, pursuant to 28 United States Code Section 2410(c) – (d), or other taxing authority, if any. Specifically, the following liens have been filed and/or claimed by the Internal Revenue Service, which taxing authority has been given timely notice of these foreclosure proceedings as required by 28 United States Code Section 2410: Notice of Federal Tax Lien, of record at Instrument Number 20250304-0016006, Davidson County, Tennessee Register of Deeds.
Once the sale terms have been fully satisfied, the successful bidder or Plaintiff may move the Court for an order to confirm the sale, which order shall also extinguish any contractual, statutory or common law right of redemption vested in the grantors (of Plaintiff's lien) and/or the grantors' (or any single grantor's) creditors, and order that title shall be absolute pursuant to Tennessee Code Annotated Section 66-8-101.
The right is reserved to adjourn the sale to another date and time or to have the sale conducted by an agent of the Clerk & Master, including an auctioneer. Any and all announcements at the time and place of the sale shall take precedence over this advertisement. The Clerk & Master reserves the right to rescind the sale.
