MORTGAGEE’S NOTICE OF SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain Mortgage given by Adilson Dos Santos Andrade to Mortgage Electronic Registration Systems, Inc., as nominee for Total Mortgage Services, LLC, its successors and assigns, dated September 30, 2021 and recorded with the Plymouth County Registry of Deeds at Book 55775, Page 41, subsequently assigned to Fifth Third Bank, National Association by Mortgage Electronic Registration Systems, Inc. ("MERS"), as nominee for Total Mortgage Services, LLC, beneficiary of the security instrument, its successors and assigns by assignment recorded in said Plymouth County Registry of Deeds at Book 57174, Page 304 for breach of the conditions of said Mortgage and for the purpose of foreclosing same will be sold at Public Auction at 1:00 PM on November 21, 2025 at 16 Hancock Street, Brockton, MA, all and singular the premises described in said Mortgage, to wit:
The land with the buildings thereon being shown as Lot A on a plan entitled "Plan of Land in Brockton, Plymouth County, Mass., Scale SCALE 1"+20', October 26, 1982, owner Nancy B. Mitchell, Trustee for N.B.M Trust, Book 4118, Page 782, prepared by Land Surveys Incorporated, 410 Belmont Street, Brockton, MA". Said plan is recorded in Plymouth County Registry of Deeds, Plan Book 23, Page 585. Said Lot A being bounded and described more particularly as follows:
SOUTHERLY by the Northerly boundary of Hancock Street as shown on said plan, 79.43 feet;
WESTERLY by land of Secretary of H.U.D. as shown on said plan, 83.95 feet;
NORTHERLY by Lot B on said plan, 61.58 feet;
EASTERLY by Lot B on said plan, 23.29 feet;
NORTHERLY again by Lot B as shown on said plan, 34.00 feet; and
EASTERLY by the Westerly boundary of Owens Avenue as shown on said plan, 38.00 feet.
Containing 5,463 square feet more or less according to said plan. For title reference see deed recorded in Book 47208, Page 6.

Upon information and belief THERE APPEARS TO BE A TYPO IN THE TITLE OF THE PLAN IN THIS DESCRIPTION, "SCALE 1"+20'" should be: "SCALE 1"=20'.
The premises are to be sold subject to and with the benefit of all easements, restrictions, encroachments, building and zoning laws, liens, unpaid taxes, tax titles, water bills, municipal liens and assessments, rights of tenants and parties in possession, and attorney’s fees and costs.
TERMS OF SALE:
A deposit of TEN THOUSAND DOLLARS AND 00 CENTS ($10,000.00) in the form of a certified check, bank treasurer’s check or money order will be required to be delivered at or before the time the bid is offered. The successful bidder will be required to execute a Foreclosure Sale Agreement immediately after the close of the bidding. The balance of the purchase price shall be paid within thirty (30) days from the sale date in the form of a certified check, bank treasurer’s check or other check satisfactory to Mortgagee’s attorney. The Mortgagee reserves the right to bid at the sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney. The description of the premises contained in said mortgage shall control in the event of an error in this publication. TIME WILL BE OF THE ESSENCE.
