MacDonald to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Mortgage Lenders Network USA, Inc., its successors and assigns, dated April 14, 2006 and recorded in Plymouth County Registry of Deeds in Book 32537, Page 247 (the “Mortgage”) of which mortgage U.S. Bank Trust Company, National Association, as Trustee, as successor-in-interest to U.S. Bank National Association, as Trustee, for Residential Asset Securities Corporation, Home Equity Mortgage Asset-Backed Pass-Through Certificates, Series 2006-EMX5 is the present holder by Assignment from Mortgage Electronic Registration Systems, Inc., as nominee for Mortgage Lenders Network USA, Inc., its successors and assigns to U.S. Bank, National Association, as Trustee for RASC 2006-EMX5 dated June 1, 2011 and recorded at said Registry of Deeds in Book 40010, Page 47, and Assignment from Mortgage Electronic Registration Systems, Inc., as nominee for Mortgage Lenders Network USA, Incorporated, its successors and assigns to U.S. Bank National Association, as Trustee, for Residential Asset Securities Corporation, Home Equity Mortgage Asset-Backed Pass-through Certificates, Series 2006-EMX5 dated March 9, 2015 and recorded at said Registry of Deeds in Book 45345, Page 50, and Assignment from U.S. Bank National Association, as Trustee, for Residential Asset Securities Corporation, Home Equity Mortgage Asset-Backed Pass-through Certificates, Series 2006-EMX5 to U.S. Bank Trust Company, National Association, as Trustee, as successor-in-interest to U.S. Bank National Association, as Trustee, for Residential Asset Securities Corporation, Home Equity Mortgage Asset-Backed Pass-Through Certificates, Series 2006-EMX8 dated June 18, 2024 and recorded at said Registry of Deeds in Book 58995, Page 316, and Assignment from U.S. Bank Trust Company, National Association, as Trustee, as successor-in-interest to U.S. Bank National Association, as Trustee, for Residential Asset Securities Corporation, Home Equity Mortgage Asset-Backed Pass-Through Certificates, Series 2006-EMX8 to U.S. Bank Trust Company, National Association, as Trustee, as successor-in-interest to U.S. Bank National Association, as Trustee, for Residential Asset Securities Corporation, Home Equity Mortgage Asset-Backed Pass-Through Certificates, Series 2006-EMX5 dated August 22, 2024 and recorded at said Registry of Deeds in Book 59191, Page 21, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 39 Olde Stage Stop Village a/k/a 848 Plain Street, Unit No. 39, Building 6, of the Olde Stage Stop Village Condominium, Marshfield, MA 02050 will be sold at a Public Auction at 12:00 PM on November 21, 2025, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
 
Unit 39 in Building 6 of Olde Stage Stop Village Condominium, created by Master Deed dated April 18, 1974, recorded with the Plymouth County Registry of Deeds in Book 3979, Page 736, as amended by instruments of record, together with a 2.065% undivided interest in the common areas and facilities of said Condominium as set forth in the Master Deed.
 
The Unit conveyed together with the right to use the Common Elements in common with the owners of other Units as provided in the Master Deed, including the rights to use the pipes, wires, ducts, flues, cables, conduits, public utility lines and other Common Elements located in any of the other Units or elsewhere in the Condominium and serving the Units, and together with the exclusive rights, as set forth in said Master Deed, to use such parking space or spaces as may be designated in writing by the Board of Managers of Olde Stage Stop Village Association (the "Association"), the attic of the building situated directly above the Unit for storage purposes, the bulkhead and exterior stairway adjacent to the basement of the Unit, the chimney in the interior bulkhead and affixed to the roof of the Unit and serving the Unit and the adjacent Unit (this being in common with the said adjacent Unit), the rear uncovered porch, patio, and rear yard, the stoop adjacent to the front door and any walks leading thereto, and the exclusive right and easement it to use, maintain and repair the air conditioner alcoves serving the Unit and located in exterior walls of the Unit. The Unit is conveyed with the benefit of all rights and easements set forth or referred to in the Master Deed.
 
The Unit conveyed subject to and with the benefit of an easement of encroachment in the event that the Unit encroaches upon any other Unit or upon any portion of the Common Elements or in the event that any other Unit or the Common Elements encroach upon said Unit, as a result of the construction of the Building or as a result of the settling or shifting ofsaid building to the extent of said encroachment. The Unit is subject to an easement for benefit of the other Units to use pipes, wires, ducts, flues, conduits, cables, public utility lines and other common Elements located in the Unit and serving other Units or Common Elements.
 
The Unit is further subject to the provisions of said Chapter 183A as it may be amended from time to time, the restrictions, rights and easements set forth or referred to in the Master Deed, the provisions of the Master Deed and By-Laws of the Association recorded with said Deeds Book 3979, Page 736 as the same may be amended from time to time by instrument duly recorded with said Deeds, which provisions, together with any amendments thereto, shall constitute covenants running with the land and shall bind any person having at any time any interest or estate in the Unit, his family, servants and visitors as though such provisions were recited and stipulated in full herein; any and all rules and regulations adopted under or pursuant to the foregoing documents and such taxes attributable to the Unit and Common Elements for the then current year as are not due and payable on the date of delivery hereof.

The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
 
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee. The description for the premises contained in said mortgage shall control in the event of a typographical error in this publication.
