NOTICE IS HEREBY GIVEN that the City Council of the City of Shreveport proposes to take final action on the following Resolutions and Ordinances Tuesday, December 9, 2025, at 3:00 p.m., via video/telephone conference or Government Chamber, (505 Travis Street) depending on the latest proclamation related to COVID-19.
ORDINANCE NO. 122 OF 2025
AN ORDINANCE DECLARING CERTAIN PAINT AND EQUIPMENT ACQUIRED WITH FEDERAL COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS AS SURPLUS AND AUTHORIZING THEIR DISPOSAL OR DONATION TO QUALIFIED NON-PROFIT ORGANIZATIONS SUBJECT TO CONDITIONS AND TO OTHERWISE PROVIDE WITH RESPECT THERETO
WHEREAS, the City of Shreveport has been designated by the United States Department of Housing and Urban Development (“HUD”) as a Community Development Block Grant (“CDBG”) Entitlement City in accordance with the regulations set forth in 24 CFR Part 570; and WHEREAS, the Department of Community Development (“the Department”) has, over several years, acquired paint and equipment for use in the Paint Your Heart Out Shreveport Program, which was established for the public purpose of benefitting low- and moderate-income citizens of the City of Shreveport; and WHEREAS, such paint and equipment were purchased with CDBG funds, which never lose their federal identity, and therefore any property or materials acquired with these funds must continue to be used for purposes that benefit low- and moderate-income families and individuals in compliance with HUD regulations; and WHEREAS, the Department of Community Development now desires to properly dispose of paint that has no remaining use and to declare the remaining paint and equipment as surplus property for donation to an eligible existing non-profit organization capable of utilizing the donated materials for activities that provide public benefit and add to the City’s housing stock in service to low- and moderate-income individuals; and WHEREAS, the eligible non-profit organization shall be selected through an open and transparent application process administered by the Department of Community Development, through which interested organizations must demonstrate their eligibility under HUD guidelines, their capacity to effectively use the donated materials for eligible CDBG activities, and their plan for ensuring that all use of donated property benefits low- and moderate-income residents; and WHEREAS, final selection and approval of the recipient non-profit organization shall be based upon compliance with applicable federal, state, and local requirements, and upon the organization’s ability to further the City’s housing and community development objectives; and WHEREAS, LSA-R.S. 33:4712 requires that notice of this ordinance be published at least three (3) times within fifteen (15) days, one week apart. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Shreveport, in legal session convened, that the paint and equipment acquired by the Department of Community Development using CDBG funds are hereby declared surplus property. BE IT FURTHER ORDAINED that the City of Shreveport, through its Department of Community Development, is hereby authorized to properly dispose of paint that has no remaining use and to donate the remaining paint and equipment to a qualified non-profit organization selected through the process described herein, subject to compliance with all applicable laws, HUD regulations, and donation conditions imposed by the Department. BE IT FURTHER ORDAINED that the Mayor of the City of Shreveport is hereby authorized to execute any and all documents necessary to carry out the intent of this ordinance following review and approval as to form by the Office of the City Attorney. BE IT FURTHER ORDAINED that if any provision or item of this ordinance or the application thereof is held invalid, such invalidity shall not affect other provisions, items or applications of this ordinance which can be given effect without the invalid provisions, items or applications and to this end the provisions of this resolution are hereby declared severable. BE IT FURTHER ORDAINED that all ordinances or parts thereof in conflict herewith are hereby repealed.
