Under and by virtue of the Power of Sale contained in a Security Deed given by Mattie Childs to EquiCredit dated May 2, 2000 and recorded on May 10, 2000 in Deed Book 212B, Page 529, Chatham County, Georgia Records, and later assigned to U.S. Bank Trust National Association, as Trustee for LB-Dwelling Series VI Trust by Assignment of Security Deed recorded on August 12, 2025 in Deed Book 3747, Page 800, Chatham County, Georgia Records, conveying the after-described property to secure a Note in the original principal amount of Fifty-Three Thousand Five Hundred Fifty And 00/100 Dollars ($53,550.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Chatham County, Georgia, within the legal hours of sale on December 2, 2025 the following described property:
All that certain lot, tract, or parcel of land situate lying and being on the Berrien Road, near the paved Augusta Road, between the Eleven (11) and Twelve (12) mile post on said Augusta Road in the Eighth (8th) G.M. District of Chatham County, Georgia, consisting of the Eastern 0.5 acres, more or less, of a One (1) Acre tract lying and being in the Southwestern corner of that original tract of Fifteen (15) acres conveyed by deed to John Capers on March 29, 1889, and recorded in the records of said County Deed Book 9 O's, Folio 276; said 0.5 acres hereby conveyed being more particularly described as follows: Start at a point where the Northern boundary line of Berrien Avenue intersects the center line of Georgia Highway 21, proceed South Seventy degrees Twenty-Nine minutes Forty-Five seconds (70 29' 45”) West a distance of 931.2 feet to a 5/8” rebar, thence proceed South Seventy degrees Twenty-Nine minutes Forty-Five seconds (70 29' 45”) West a distance of 138.50 feet to a 5/8” rebar, thence South Twenty degrees Nineteen minutes Forty-Five seconds (20 19' 45”) West a distance of 15 feet to a concrete monument set (c.m.s.) and the point of beginning; thence North Twenty degrees Nineteen minutes Forty-Five seconds (20 19' 45”) West a distance of 160.01 feet to a (c.m.s); then North Seventy degrees Thirty-One minutes Forty seconds (70 31' 40”) East a distance of 138.50 feet to a c.m.s., thence South Twenty degrees Nineteen minutes Forty-Five seconds (20 19' 45”) East a distance of 160 feet to a c.m.s., thence South Seventy degrees Twenty-Nine minutes Forty-Five seconds (70 29' 45”) a distance of 138.50 to the point of beginning; and being bounded as follows: on the North by property now or formerly belonging to Reid Grant, on the East by property now or formerly belonging to Jacob Webb, on the South by Berrien Avenue, on the West by property now owned by Marthella C. Bryant, formerly owned by Bertha Childs.
This being part of the same property conveyed to Charlie Thompkins to Bertha Childs by Warranty Deed dated October 18, 1956 and recorded in the Clerk's Office of the Superior Court of Chatham County, Georgia in Record Book 65-T, Folio 371 and being the Eastern One Half (1/2) of said tract as shown on a plat made By Paul D. Wilder, Rincon, Georgia, Registered Land Surveyor No. 1559, and dated August 31, 1982. Subject to all easements, restrictions, and reservations of record.

The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney’s fees (notice of intent to collect attorney’s fees having been given).

The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
