APPEAL OF AN ADMINISTRATIVE DECISION CASE:
APPEAL 2025-15
G. Grady Richardson, applicant, on behalf of Salty Acres Adventure Park, LLC, owner, is requesting an Appeal of an Administrative Decision made by staff to issue a notice of violation to Salty Acres Adventure Park, LLC for operating a commercial enterprise without proper permits in violation of the County’s Unified Development Ordinance. The subject site is located on the north side of Carl Meeks Road, west of Shaw Highway in the Holly Township. The site may be further identified by Pender County Parcel Identification Numbers 3257-39-6422-0000 and 3257-59-0861-0000.
VARIANCE CASE: VAR 2025-24
Baker Commercial Properties – Baker Commercial NC, LLC, applicant, on behalf of Lee Properties of Scotts Hill, LLC, owner, is requesting a variance for relief from the Pender County Unified Development Ordinance standards outlined in Sections 8.1.3 ‘Tree Survey Required.' Specifically, the request is to seek relief from the tree mitigation requirement to allow the applicant to not be required to plant 146 out of the total 334 required mitigation trees for a commercial development. The subject property is in the GB, General Business, zoning district and is located at the southern corner of the intersection of US Hwy 17 and Scotts Hill Loop Rd across from Blake Farm Blvd in the Topsail Township. There are two tracts associated with this request totaling approximately 11.5 acres of land associated with this request and may be further identified by Pender County PINs 3271-30-9965-0000 & 3271-30-6743-0000.

Jeremy & Amanda Marshburn, owners and applicants, are requesting the approval of variance for relief from Pender County Unified Development Ordinance standards outlined in Article 4.14, Zoning District Dimensional Requirements. The request is to allow an existing structure to be utilized as an accessory dwelling unit within the required rear setback of 25 feet. Specifically, the request is for 15.7 feet of relief from the required rear setback of 25 feet. The subject property is within the RP, Residential Performance, zoning district and is located at 349 Scottsdale Dr. approximately 385 feet from the intersection of Scottsdale Dr. and Scotts Hill Loop Rd in the Topsail Township. The subject property may be further identified by Pender County PIN 3270-94-6837-0000.
VARIANCE CASE: VAR 2025-26
Jolene Johnson, owner and applicant, is requesting a variance for relief from Pender County Unified Development Ordinance standards outlined in Article 5.3.3.A, Accessory Structure Setbacks and Separation Requirements. Specifically, the request is to allow an encroachment of 2.7 feet of the accessory structure into the 10-foot side setback. The subject property is within the RP, Residential Performance, zoning district and is located at 86 Oaks Plantation Dr. approximately 362 feet from the intersection of Oaks Plantation Dr. and US Highway 117 in the Rocky Point Township.
