By virtue and in execution of the Power of Sale contained in a certain mortgage given by Stephen Schelle, Brianne Florencio to Mortgage Electronic Registration Systems, Inc., as nominee for Total Mortgage Services, LLC, dated March 24, 2023 and recorded in the Bristol County (Southern District) Registry of Deeds in Book 14638, Page 44 and as affected by a judgment dated July 29, 2025 and recorded with said Registry on August 20, 2025, in Book No. 15300, at Page 273, of which mortgage the undersigned is the present holder, by assignment from:
Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Total Mortgage Services, LLC, its successors and assigns to PennyMac Loan Services, LLC, recorded on November 14, 2024, in Book No. 15153, at Page 53
for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at 9:00 AM on December 4, 2025, on the mortgaged premises located at 537 South Second Street, New Bedford, Bristol County, Massachusetts, all and singular the premises described in said mortgage,

BEGINNING at a stake in the northerly line of land now or formerly of Angelo C. DeMello, et ux, said stake being sixty-two (62) feet westerly of another stake in the westerly line of South Second Street. which stake is eighty (80) feet southerly from a bound stone at the southwest corner of Delano Street and South Second Street;
thence SOUTHERLY in line of land now or formerly of said Angelo C. DeMello et ux, thirty-one and 10/100 (31.10) feet to a point marked by two tacks in a fence at land of the City of New Bedford;
thence WESTERLY in line of last named land, twenty-one and 67/100 (21.67) feet to a drill hole,
thence SOUTHWESTERLY still in line of last-named land, thirty-three and 32/100 (33.32) feet to a drill hole at land of parties unknown;
thence NORTHERLY in line of last-named land, thirty-six (36) feet to a tack in a fence at land now or formerly of Mary P. Winterson;

BEING shown on a Plan of Land of Angelo C. DeMello dated November 17, 1947 and filed in the Bristol County (S.D.) Registry of Deeds in Plan Book 38, Page 54.
TOGETHER with a right of way for all purposes extending easterly from the above-described parcel to the west line of South Second Street as shown on said plan. Being the same premises conveyed to Joseph V. Porto and Maryanne Porto by deed of Stanley J. Gadomski and Mary Gadomski, dated March 8, 1972 and recorded in said Registry in Book 1636, Page 839. Beginning at the southwest corner of the land herein described, as a point which is distant northeasterly therein, one hundred eight and 50/100 (108.50) feet from the easterly line of Acushnet Avenue, and at southeasterly corner of Parcel B, as shown on plan of land hereinafter mentioned;
thence North 15° 23' 28" West, in line of last named Parcel B, thirty-eight and 54/100 (38.54) feet to a point in the southerly line of land now or formerly of George S. and Mercedes S. Soares, as shown on said plan;
thence North 75° 20' 14" East in line of last-named land, twenty-eight and 00/100 (28.00) feet to a point formed by the southwest corner of land now or formerly of Mina E. Pires and at the north-west corner of land now or formerly of Mary Ann Porto as shown on said plan;

These premises will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
TERMS OF SALE:
A deposit of Ten Thousand ($10,000.00) Dollars by certified or bank check will be required to be paid by the purchaser at the time and place of sale.
