MORTGAGEE'S SALE OF REAL ESTATE
By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Phillip Macleod, Sr. to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Countrywide Bank, a Division of Treasury Bank, N.A., its successors and assigns, dated November 19, 2004 and recorded in Plymouth County Registry of Deeds in Book 29540, Page 60 (the “Mortgage”) of which mortgage Towd Point Mortgage Trust 2023-1, U.S. Bank Trust Company, National Association as Indenture Trustee is the present holder by Assignment from Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Countrywide Bank, a Division of Tresury Bank, N.A., its successors and assigns to Bank of America, N.A. dated June 13, 2022 and recorded at said Registry of Deeds in Book 56935, Page 192, and Assignment from Bank of America, N.A. to FirstKey Mortgage, LLC dated December 1, 2022 and recorded at said Registry of Deeds in Book 57482, Page 339, and Assignment from FirstKey Mortgage, LLC to Towd Point Mortgage Trust 2023-1, U.S. Bank Trust Company, National Association as Indenture Trustee dated December 1, 2022 and recorded at said Registry of Deeds in Book 58629, Page 27, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 15 Clara Road, Brockton, MA 02302 will be sold at a Public Auction at 10:00 AM on December 4, 2025, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
A certain parcel of land with the buildings thereon, situated in Brockton, Plymouth County, Massachusetts, being shown as Lot 163 on a plan entitled "Indian Heights at Brockton, Mass." dated November 1, 1955, by Bradford Saivetz, C.E. duly recorded with Plymouth County Registry of Deeds as Plan 33 of 1956, on January 20, 1956, in Plan Book 10, Page 698, more particularly bounded and described as follows:
Northerly by lot 162 as shown on said plan, 142.77 feet,
Easterly by part of Lot 167 as shown on said plan 72.40 feet,
Southerly by part of Lots 165 and 164 as shown on said plan, 137.86 and
Westerly by Clara Road, as shown on said plan, 100 feet.
Containing according to said plan, 12,096 square feet of land.
For mortgagor’s title see deed recorded with the Plymouth County Registry of Deeds in Book 26144, Page 118.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee. The description for the premises contained in said mortgage shall control in the event of a typographical error in this publication.
