AN ORDINANCE AMENDING

ORDAIN THAT CHAPTER 404
STREETS AND SIDEWALKS DO
HEREBY BE AMENDED TO
INCLUDE SECTION 24
CONSTRUCTION HOURS AND
EMERGENCY EXCEPTIONS
SECTION 1. Whereby the Village of Bellevue has authority to legally amend the Village Municipal Code from time to time as granted in Chapter 1 General Provisions.
SECTION 2. Chapter 404 Streets and Sidewalks of the Village of Bellevue Municipal Code, is hereby amended to include:
404-24 Construction Hours and
Emergency Exceptions
A. Construction Hours
(1) Purpose. This regulation is intended to maintain the peace and quiet of neighborhoods and prevent disturbances caused by construction activities during early mornings, late evenings, and designated rest hours.
(2) Regular Construction Hours. There shall be no construction-related activity conducted beyond the hours of 6:30 a.m. to 8:00 p.m., Monday through Saturday, and beyond 8:00 a.m. to 5:00 p.m. on Sundays.
(3) Exceptions. With the exception of an emergency outlined in B(1), the Village Board shall be notified and provide a decision if a contractor or construction company is requesting a deviation from Regular Construction Hours referenced in A(2). A formal request is to be provided to the Director of Public Works or Designee for action at the next available Board meeting. Whenever possible, the contractor or construction company conducting work in the Village should reach out in advance of the project where any requested deviation in construction hours is made well in advance of the project work.
B. Emergency Exceptions
(1) Emergency Construction. Construction activities necessary to address emergencies, such as public safety hazards, urgent repairs, unforeseen issues typically less than three days in duration, or natural disaster responses, may be conducted outside the designated hours.
(2) Authority and Discretion. All emergency construction activities outside regular hours shall require prior approval at the discretion of the Director of Public Works or their Designee. The Director or Designee shall determine whether the situation qualifies as an emergency warranting exceptions to these hours.
(3) Notification. Whenever possible, the contractor or responsible party shall notify the Department of Public Works of the emergency and the expected duration of the activity.
C. Enforcement
(1) Violations of this chapter shall be subject to penalties as provided by local ordinance and/or Village Fee Schedule, including fines and possible issuance of stop-work orders.
SECTION 4. All ordinances or parts of ordinances, in conflict herewith are hereby
repealed.
SECTION 5. This ordinance shall take effect upon its adoption and publication.
