MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Polar Views LLC to Steven A. Ross, Trustee of QS Lending Three Trust, dated February 22, 2024 and recorded on February 23, 2024 with the Worcester County Registry of Deeds in Book 70223, Page 208 of which mortgage the undersigned is the present holder, and in which the mortgaged premises consist of a certain parcel of land with the buildings and improvements thereon located in Worcester known as 40-42 Hooper Street, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 11:30AM on the 17th day of December 2025, at the mortgaged premises located at 40-42 Hooper Street, Worcester, Worcester County, Massachusetts, all and singular the premises described in said mortgage.

The land situated on the easterly side of Hooper Street in Worcester, Worcester County, Massachusetts, bounded and described as follows:
About 5,278 square feet of land situated on the easterly side of Hooper Street and adjoining estate now or formerly of Anthony P. Gaides, being Lot #18 as shown on Assessor’s Plan Book 16, Page 4, now or formerly owned by Louis Palmer, Henry J. Vottler, Jr. and Geroge Kester.
Being the same premises conveyed to Kochin Builders, Inc. by deed dated June 6, 2005 and recorded with the Worcester District Registry in Book 36515, Page 300.
Parcel 2
That certain parcel of land with all the buildings and improvements thereon, situated on the southeasterly side of Hooper Street in the City of Worcester, County of Worcester, Commonwealth of Massachusetts, bounded and described as follows:
Beginning at the northerly terminus of Hooper Street at the northwesterly corner of the herein described premises.
THENCE 8. 60°35’05”E., one hundred nine and 99/100 (109.99) feet to a point;
THENCE 8.30°31’45”W. by land now or formerly of Domenic Zarette and land now or formerly of Harry A. Kilmer, ninety-seven and 55/100 (97.55) feet to a point;
THENCE N.60°50’15”W. by land now or formerly of Arthur P. Gaides, one hundred ten and 00/100 feet to a point;
THENCE N.30°31”45”e. BY SAID Hooper Street, ninety-eight and 04/100 (98.04) feet to the point of beginning.
Containing 10,755 square feet.
The above parcel may be further described as Parcel 3 on that plat entitled “Land in Worcester, Massachusetts, owned by Matthew P. O’Regan, et ux., Scale 1”=40’, dated February 1973, Reney Brothers, Inc. Registered Engineers & Land Surveyors, Worcester, Massachusetts”, which said plat is duly recorded with the Worcester County Registry of Deeds in Plan Book 377, Plan 94.
For title see deed recorded with said Worcester District Registry of Deeds on February 23, 2024 in Book 70223, Page 204.
Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid condominium fees, taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed. No representations express or implied are made with respect to any matter concerning the premises, which will be sold “as-is”.
TERMS OF SALE:
Fifty Thousand and 00/100 Dollars ($50,000.00) shall be paid in certified or bank cashier's check by the purchaser at the time and place of said sale, and the balance of the purchase price shall be paid by certified or bank cashier's check at the offices of Erik T. Potter, Esq., Potter MacLellan LLP, 113 Ripley Road, Cohasset, MA 02025 within thirty (30) days from the date of sale. The successful bidder of the sale of the premises shall be required to sign a Memorandum of Terms of Sale containing the above terms at the Auction Sale. The Mortgagee reserves the right to bid at sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The Purchaser shall have no further recourse against the Mortgagor, the Mortgagee, or the Mortgagee’s attorney. The description of the premises contained in said mortgage shall control in the event of an error in this publication.
