NOTICE OF FORECLOSURE SALE
ETOWAH COUNTY, ALABAMA
Default having been made in the payment of the indebtedness secured by that certain mortgage given by Jeremy Hare, An Unmarried Man to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Guild Mortgage Company, dated November 16, 2017, and recorded at Instrument # 3459486 on November 17, 2017, in the Office of the Judge of Probate of Etowah County, Alabama, as last transferred to Freedom Mortgage Corporation by assignment, recorded on October 12, 2018, Instrument Number 3474721 in the Office of the Judge of Probate of Etowah County, Alabama, conveying the after-described property to secure a Note in the original principal amount of Sixty-Eight Thousand Six Hundred Eighty-Six and 0/100 dollars ($68,686.00), with interest thereon as set forth therein. Brock and Scott, PLLC, as counsel for Mortgagee or Transferee and under and by virtue of power of sale contained in the said mortgage will, on January 21, 2026, sell at public outcry to the highest bidder for cash at the main courthouse entrance of Etowah County, Alabama, within the legal hours of sale, the following described property:
PARCEL ONE:
A TRACT OF LAND DESCRIBED AS BEGINNING AT THE NORTHWEST CORNER OF THE SW 1/4 OF THE NW 1/4 OF SECTION 17, TOWNSHIP 12, RANGE 4 EAST, AND RUN SOUTH ALONG THE WEST LINE OF SAID 40 ACRES, A DISTANCE OF 440 FEET TO A POINT; THENCE RUN EAST AND PARALLEL WITH THE NORTH LINE OF SAID 40 ACRES, A DISTANCE OF 660 FEET TO A POINT; THENCE RUN NORTH AND PARALLEL WITH THE WEST LINE OF SAID 40 ACRES; A DISTANCE OF 440 FEET TO INTERSECT THE NORTH LINE OF SAID 40 ACRES; THENCE RUN WEST ALONG THE NORTH LINE OF SAID 40 ACRES, A DISTANCE OF 660 FEET, TO THE POINT OF BEGINNING, CONTAINING 6.66 ACRES, MORE OR LESS, TOGETHER WITH ALL IMPROVEMENTS AND APPURTENANCES SITUATED THEREON, AND LYING AND BEING IN THE SOUTHWEST QUARTER (SW 1/4) OF THE NORTHWEST QUARTER (NW 1/4) OF SECTION SEVENTEEN (17), TOWNSHIP TWELVE (12), RANGE FOUR (4) EAST, IN ETOWAH COUNTY, ALABAMA.
PARCEL TWO:
AN EASEMENT 10 FEET IN WIDTH FOR THE PURPOSE OF CONSTRUCTING AND MAINTAINING A WATER LINE FROM THE WELL OF GRANTOR TO THE SOUTH PROPERTY LINE OF GRANTEE, MORE PARTICULARLY DESCRIBED AS FOLLOWS:
A TRACT OF LAND 10 FEET OF EVEN WIDTH COMMENCING ON THE NORTH SIDE AND IN THE CENTER OF THE WELL OF GRANTOR LOCATED ON THE WEST SIDE OF THE GALLANT PUBLIC ROAD IN THE SW 1/4 OF NW 1/4 THENCE NORTH AND PARALLEL WITH THE WEST LINE OF SAID 40 A DISTANCE OF 150 FEET, MORE OR LESS, TO A POINT IN THE SOUTH LINE OF THE PROPERTY DESCRIBED IN PARCEL ONE, AND LYING AND BEING IN THE SOUTHWEST QUARTER (SW 1/4) OF NORTHWEST QUARTER (NW 1/4), SECTION SEVENTEEN (17), TOWNSHIP TWELVE (12), RANGE FOUR (4) EAST, ETOWAH COUNTY, ALABAMA.
The debt secured by said Mortgage has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Mortgage. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Mortgage and by law, including attorney’s fees.
This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, and exceptions reflected in the mortgage and those contained in the records of the Office of the Judge of Probate of the County where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.
Alabama law gives some persons who have an interest in property the right to redeem the property under certain circumstances. To the best knowledge and belief of the undersigned, the party in possession of the property is Jeremy Hare or tenant(s); and said property is more commonly known as 9544 Gallant Rd, Gallant, AL 35972.
The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code (2) final confirmation and audit of the status of the loan with the holder of the mortgage and (3) any right of redemption or other lien not extinguished by foreclosure.
