The Department has prepared a draft permit and has made a tentative determination, subject to public comment or other information, to approve a proposed 0.05MGD wastewater treatment plant (WWTP) with discharge of treated sanitary wastewater to Lake Sebago (Class A, Waters Index # NJ-12-6-P1002E). The WWTP will provide tertiary treatment with a biological active filter treatment process at the applicant's facility address located at Lake Sebago in Harriman State Park. The applicant plans to rehabilitate the Lake Sebago beach area, including the bathhouse, park buildings, wastewater treatment plant, parking areas and tent sites.

Requests for a legislative (public statement) hearing must be sent in writing to the DEC contact person below by the comment deadline. The Department assesses such requests pursuant to 6 NYCRR Section 621.8. Refer to this application by the application number listed above and SPDES Number NY0145220.

The applicant proposes disturbance within Lake Sebago (Class A, Waters Index # NJ-12-6-P1002E) and Stillwater Creek (Class B, Waters Index # NJ-12-6-P1002E-3) associated with restoration activities within the beach and swimming area, removal of the New Sebago Beach Dam (NYS ID 196-1282) and daylighting of a portion of Stillwater Creek, creation and restoration of wetlands, and installation of an outfall for the wastewater treatment system. In total, these proposed activities will require approximately 775 cubic yards (CY) of excavation and 2,100 CY of fill within Waters of the United States. All work will occur while the Lake Sebago water level is drawn down, which is an annual occurrence. Sediment and erosion control measures will also be employed.

State Environmental Quality Review (SEQR) Determination:
Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other involved agencies was performed and a Negative Declaration is on file.

NYS Office of Parks Recreation & Historic Preservation
State Historic Preservation Act (SHPA) Determination:
A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.
