NOTICE OF SALE UNDER POWER
Pursuant to the power of sale contained in the Security Deed executed by OLYMPIA THOMAS to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., AS GRANTEE, AS NOMINEE FOR SOUTHPOINT FINANCIAL SERVICES, INC. in the original principal amount of $209,401.00 dated August 1, 2024, and recorded in Deed Book 3470, Page 651, Chatham County records, said Security Deed being last transferred to PLANET HOME LENDING, LLC. in Deed Book 3587, Page 757, Chatham County records, the undersigned will sell at public outcry to the highest bidder for cash, before the Courthouse door in said County, or at such other place as lawfully designated, within the legal hours of sale, on January 6, 2026, the property in said Security Deed and described as follows:
ALL THAT CERTAIN LOT, TRACT OR PARCEL OF LAND SITUATE, LYING AND BEING IN THE MITCHELL WARD, CITY OF SAVANNAH, COUNTY OF CHATHAM, STATE OF GEORGIA, IN A SUBDIVISION KNOWN AS WEST HILL, AND BEING KNOWN ON THE OFFICIAL MAP OR PLAN OF SAID CITY OF SAVANNAH AS LOT NUMBER SIXTY-NINE (69), WEST HILL SUBDIVISION, MITCHELL WARD, AND AS SHOWN UPON THAT CERTAIN MAP OR PLAT OF SAID SUBDIVISION ENTITLED "PLAT OF SUBDIVISION KNOWN AS WEST HILL, ADJOINING THE CITY OF SAVANNAH, GA., SUBDIVIDED FOR MESSRS, YOUMANS & DEMMOND", RECORDED IN DEED BOOK 10-E, PAGE 390, IN THE OFFICE OF THE CLERK OF THE SUPERIOR COURT OF CHATHAM COUNTY, GEORGIA, SAID MAP OR PLAT BEING SUBSEQUENTLY CONVERTED AND RECORDED IN HISTORICAL MAP BOOK 4, PAGE 218, IN THE AFORESAID CLERK'S OFFICE RECORDS. SAID RECORDED MAP OR PLAT IS HEREBY INCORPORATED HEREIN AND EXPRESSLY MADE A PART OF THIS DESCRIPTION BY SPECIFIC REFERENCE THERETO FOR A MORE PARTICULAR DESCRIPTION OF THE SAID PROPERTY BEING DESCRIBED AND CONVEYED HEREIN. SAID LOT NUMBER SIXTY-NINE (69) HAVING A SOUTHERN FRONTAGE OF THIRTY (30') FEET ON THE NORTH SIDE OF THE RIGHT OF WAY KNOWN AS DEMMOND STREET (FORMERLY KNOWN AS HULL STREET), WITH A RECTANGULAR DEPTH OF NINETY (90') FEET EXTENDING IN A NORTHWARDLY DIRECTION TO A LANE, AND BEING BOUNDED AS A WHOLE AS FOLLOWS: ON THE NORTH BY SAID LANE; ON THE EAST BY LOT NUMBER SEVENTY (70), SAID SUBDIVISION AND WARD; ON THE SOUTH BY THE RIGHT OF WAY KNOWN AS DEMMOND STREET (FORMERLY KNOWN AS HULL STREET); AND ON THE WEST BY LOT NUMBER SIXTY-EIGHT (68), SAID SUBDIVISION AND WARD. SAID PROPERTY CONTAINING IMPROVEMENTS LOCATED THEREON MORE COMMONLY KNOWN UNDER THE PRESENT NUMBERING SYSTEM AS 1032 DEMMOND STREET, SAVANNAH, GEORGIA 31415; AND BEARING A CHATHAM COUNTY TAX P.I.N. OF 2-0019-15-033.
Said property being known as: 1032 DEMMOND ST, SAVANNAH, GA 31415
To the best of the undersigned’s knowledge, the party or parties in possession of said property is/are OLYMPIA THOMAS or tenant(s).
The debt secured by said Security Deed has been and is hereby declared due and payable because of, among other possible events of default, failure to pay the indebtedness as provided for in the Note and said Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of sale, including attorney’s fees (notice of intent to collect attorney’s fees having been given).
Said property will be sold subject to the following: (1) any outstanding ad valorem taxes (including taxes which are a lien, whether or not yet due and payable); (2) the right of redemption of any taxing authority; (3) any matters which might be disclosed by an accurate survey and inspection of the property; and (4) any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
Said sale will be conducted subject to the following: (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the Security Deed.
