MORTGAGE FORECLOSURE SALE
Default having been made in the payment of the indebtedness secured by that certain Mortgage dated June 15, 2004 executed by Robert A. Sedgwick II and Kelly W. Sedgwick (collectively, “Mortgagor”) to Branch Banking and Trust Company, successor in interest to Colonial Bank by asset acquisition from the Federal Deposit Insurance Corporation as receiver for Colonial Bank, and recorded on June 17, 2004, in RLPY Book 2004, Page 5509, as affected by that certain Assignment of Security instruments and Other Loan Documents from the Federal Deposit Insurance Corporation as receiver for Colonial Bank to Branch Banking and Trust Company, recorded October 20, 2009, in the Probate Records of Autauga County, in RLPY 2009, Page 8032, which Mortgage was assigned to Edgefield Holdings, LLC, via assignment recorded on April 23, 2024, in RLPY Book 2024, Page 2678, and which Mortgage was further assigned to Edgefield Commercial Properties, LLC (“Mortgagee”), via instrument recorded on April 24 2024, in RLPY Book 2024, Page 2711, and which was modified via an instrument dated October 29, 2024, Mortgagee, under and by virtue of the power of sale contained in said Mortgage will sell, at public outcry to the highest bidder for cash, in front of the main entrance to the county courthouse in the City of Prattville, Autauga County, Alabama on December 30, 2025 during the legal hours of sale, the following described real estate situated in Autauga County, Alabama:
Lot Number Five (5) of High Hills Subdivision as shown by map recorded in the Office of the Judge of Probate of Autauga County, Alabama, in Deed Book 86, at Page 80, and re-recorded in Map Book 2, at Page 19.
All recording references herein are to the Office of the Judge of Probate of Autauga County, Alabama. This sale is made for the purpose of paying the indebtedness secured by said mortgage, as well as the expenses of foreclosure.
The holder of the Mortgage makes no representation or warranty as to the physical condition of the real estate and/or any improvements thereon. The above-described property will be sold: (i) on an “as is” basis, subject to any unpaid taxes, all reservations and restrictions contained in prior deeds and all other matters of record, including restrictive covenants and easements for road rights of way, utilities or rights of ingress and egress; (ii) without representation, warranty or recourse, express or implied, as to title, condition, use and/or enjoyment of the property; and (iii) subject to the statutory right of redemption. This sale is subject to being postponed or cancelled.
