By virtue and in execution of the POWER OF SALE contained in a certain mortgage given by GARY S. BERTOCCI to Cv3 Financial Services, LLC dated June 22, 2024 and recorded in the Bristol (North) County Registry of Deeds in Book 28906 Page 153, thereafter assigned to CV3 Alpha Trust dated June 25, 2024 and recorded in the Bristol (North) County Registry of Deeds in Book 28917 Page 189 thereafter assigned to Wilmington Savings Fund Society FSB not in its individual capacity but solely as Owner Trustee of ATLAS SP Resi Opportunity Trust IA dated October 16, 2024 and recorded in the Bristol (North) County Registry of Deeds in Book 29064 Page 314 thereafter assigned to Wilmington Savings Fund Society FSB not in its individual capacity but solely as Owner Trustee of ATLX 2025 RTL 1 Trust on July 2, 2025 and recorded in the Bristol (North) County Registry of Deeds in Book 29423 Page 266 of which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at 1:00 P.M. on December 30, 2025 on the mortgaged premises known as 15 Scotch Dam Road, South Easton, MA 02375 being all and singular the premises described in said mortgage, to wit:
The Land referred to herein below is situated in the County of Bristol, Commonwealth of Massachusetts, and is described as follows: A certain parcel of land in Easton, Bristol County, Massachusetts, with the buildings thereon, situated on Scotch Dam Road, containing 30,128 square feet of land, more or less, and being shown as Lot 7 on "Definitive Plan of Land in Easton, owned by S. Tyson Haldeman et ux, Scale 1" = 40', October 10, 1967, Hayward, Hayward & Boynton, Engineers". Said Plan being duly recorded in Bristol Northern District Registry of Deeds in Plan Book 111, Page 67.
Being the same premises conveyed to this mortgagor Alycar Investments LLC by deed with Bristol (Northern District) Registry of Deeds in Book 28581, Page 22.
The above-described premises will be sold SUBJECT TO and with the benefit of all restrictions, easements, improvements, to any and all unpaid taxes, tax title, tax liens, water and sewer charges, municipal or other public taxes, assessments or liens, to all tenancies and parties in possession, if any, which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens, tenancies or encumbrances is made in the deed.
TERMS OF SALE: TEN THOUSAND ($10,000.00) DOLLARS will be required to be paid in cash, by certified check, or by cashier’s check by the purchaser at the time and place of sale as a deposit. The balance of the purchase price shall be paid in cash, by certified check or by cashier’s check by the purchaser within 30 days thereafter at the offices of Philip L. Eiker, Attorney for the Mortgagee, P.O. Box 1241, Patagonia, AZ 85624. Deed will be provided to purchaser for recording upon receipt in full of the purchase price.
