NOTICE OF INTENT TO ISSUE
Title V Operating Permit No. 09-00017
Notice is hereby given, pursuant to 25 Pa. Code, Section 127.424 and 25 Pa. Code, Section 127.521, that the Pennsylvania Department of Environmental Protection (DEP) intends to renew a Title V Operating Permit to Constellation Energy Generation Co, located at 1123 Old Bristol Pike, Morrisville, Bucks County.
The Constellation Energy Generation Co is an unmanned peaking power production station, operating only during times of high electricity demand. The facility operates three (3) identical combustion turbines. As a result of the potential levels of nitrogen oxides (NOx) emitted, the Constellation Energy Generation Co is a major stationary source as defined in Title I, Part D of the Clean Air Act Amendments. The facility is therefore subject to the Title V permitting requirements adopted in 25 Pa. Code, Chapter 127, Subchapter G. The facility’s major emission points are: three (3) identical simple cycle combustion turbines. Facility-wide potential to emit for each pollutant is: NOx – 170.56 tons per year (TPY); sulfur oxides (SOx) – 6.40 TPY; particulate matter (PM) – 0.83 TPY; carbon monoxide (CO) – 0.64 TPY; and volatile organic compounds (VOC) – 0.079 TPY. The existing facility is currently operating under Title V Operating Permit No. 09-00017. Since the turbines were installed in 1970, no federal regulations are applicable to the units. The turbines are subject to state regulation and RACT III. All new and revised regulatory changes have been addressed in this renewal, including presumptive RACT III requirements for the turbines. The proposed Title V Operating Permit Renewal does not reflect any change in air emissions from the facility. The current Title V Permit was issued on March 9, 2020. Upon final approval, the permit will be issued for a period of five (5) years.
Copies of the renewal TVOP application, proposed renewal TVOP, and other relevant information are available for public review at DEP’s Southeast Regional Office, 2 East Main Street, Norristown, PA 19401. An appointment to review the documents may be scheduled by calling the Records Management Section of DEP’s Southeast Regional Office at 484.250.5910 between 8:00 A.M. and 4:00 P.M., Monday through Friday, except holidays.

Written comments should include:
- the name, address, and telephone number of the person(s) submitting the comments;
- identification of the proposed renewal TVOP including the permit number; and
- a concise statement regarding the relevancy of the information or objections to issuance of the proposed renewal TVOP.
DEP may, in its discretion, hold a public hearing regarding the proposed renewal TVOP if it decides that such a hearing is warranted based upon the comments, information, and objections received. All persons submitting comments, information, and/or objections, or otherwise requesting a hearing, will be notified of DEP’s decision to hold a public hearing by publication in this newspaper and/or the Pennsylvania Bulletin, except when DEP determines that notification by telephone is sufficient.
