ORDINANCE NO. 2025-1641
AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE CITY OF GOODYEAR, MARICOPA COUNTY, ARIZONA, AMENDING GOODYEAR CITY CODE, CHAPTER 13 TRAFFIC, ARTICLE 13, ADMINISTRATION, BY ADDING SECTION 13-1-4 RELATED TO POWERS OF UNARMED POLICE ASSISTANTS AND TRAFFIC INVESTIGATORS.
WHEREAS, unarmed police assistants are a valuable resource to the City; and
WHEREAS, the current Goodyear City Code does not authorize police assistants to conduct traffic accident investigations or issue citations for violations of state statutes and the City Code of Goodyear, as explicitly authorized by Arizona state law.
WHEREAS, the Mayor and Council of the City of Goodyear, Arizona, believe that it is in the best interest of the City and the citizens of Goodyear to approve the enactment of Section 13-1-4 of the Goodyear City Code.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF GOODYEAR, MARICOPA COUNTY, ARIZONA, AS FOLLOWS:
SECTION 1.AMENDING CHAPTER 13 TRAFFIC OF GOODYEAR CITY CODE
The City Code of Goodyear, Arizona, Chapter 13 TRAFFIC, is hereby amended to enact a new Section 13-1-4 entitled, Unarmed Police Assistants and Traffic Investigators, to read as follows:
§ 13-1-4. UNARMED POLICE ASSISTANTS AND TRAFFIC INVESTIGATORS.
(A) UNARMED POLICE ASSISTANTS MAY BE EMPLOYED OR UTILIZED BY THE POLICE DEPARTMENT AND SHALL BE EMPOWERED TO COMMENCE AN ACTION OR PROCEEDING BEFORE A COURT OR JUDGE FOR ANY VIOLATION OF CITY CODE REGULATING THE STANDING AND PARKING OF VEHICLES.
(B) UNARMED POLICE ASSISTANTS MAY ALSO SERVE AS TRAFFIC INVESTIGATORS WHO MAY:
(1) INVESTIGATE TRAFFIC ACCIDENTS WITHIN THE CITY OF GOODYEAR;
(2) COMMENCE AN ACTION IN THE GOODYEAR MUNICIPAL COURT BY FILING A CITATION FOR ANY CIVIL VIOLATION OF A STATE STATUTE OR THIS CODE RELATING TO SUCH TRAFFIC ACCIDENTS.
(C) UNARMED POLICE ASSISTANTS MAY ALSO COMMENCE AN ACTION IN THE GOODYEAR MUNICIPAL COURT FOR ANY CIVIL VIOLATION OF THE GOODYEAR CITY CODE SECTIONS 13-5 AND 13-6 RELATING TO MOTORIZED SKATEBOARDS AND SHARED MOBILITY DEVICES.
(D) FOR THE PURPOSES OF THIS SECTION, THE TERM “POLICE ASSISTANTS” SHALL HAVE THE SAME MEANING AS “UNARMED POLICE AIDES,” AS PROVIDED IN A.R.S. 28-627(E).
SECTION 2. REPEAL OF CONFLICTING ORDINANCES OR CODE
All ordinances or parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed upon the effective date of this ordinance.
SECTION 3.CORRECTIONS
The City Clerk and the codifiers of this Ordinance are authorized to make necessary clerical corrections to this Ordinance, including, but not limited to, the correction of scrivener’s/clerical errors, references, ordinance numbering, section/subsection numbers, and any references thereto.
SECTION 4.SEVERABILITY
If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity of the remaining portions thereof.
SECTION 5.EFFECTIVE DATE
This Ordinance shall become effective as prescribed by law.
PASSED AND ADOPTED by the Mayor and Council of the City of Goodyear, Maricopa County, Arizona, by a 7-0 vote, this 8th day of December, 2025.
