33 Hayes Memorial Drive LEGAL NOTICE NOTICE OF TIER RE-CLASSIFICATION RDC International (Former Rotadyne) 33 Hayes Memorial Drive, Marlborough, MA RELEASE TRACKING NUMBER (RTN) 2-0020366 A release of oil and/or hazardous materials has occurred at this location, which is a disposal site as defined by M.G.L. c. 21E, § 2 and the Massachusetts Contingency Plan, 310 CMR 40.0000. To evaluate the release, a Phase I Initial Site Investigation was performed pursuant to 310 CMR 40.0480. On November 13, 2018, the Phase I ISI was submitted to the Massachusetts Department of Environmental Protection (MassDEP), and the site was classified as TIER II. On January 28, 2021, the site was reclassified as Tier I due to an Immediate Response Action (IRA) condition. On June 20, 2024, the continued operation of the Active Exposure Pathway Mitigation Measure (AEPMM) system was incorporated into the Remedial Action Plan, at which point the Tier I Criterion was no longer met and the IRA was closed. Therefore, a TIER II Re-Classification Submittal has been provided to MassDEP.
