ORDINANCE S-52468
AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH M.A. MORTENSON CO. TO PROVIDE CONSTRUCTION MANAGER AT RISK PRECONSTRUCTION AND CONSTRUCTION SERVICES FOR THE PHOENIX SKY HARBOR INTERNATIONAL AIRPORT TERMINAL 4 INFRASTRUCTURE NORTH CONCOURSE 4 PASSENGER BOARDING BRIDGES REPLACEMENT PROJECT; TO EXECUTE AMENDMENTS TO THE AGREEMENT AS NECESSARY WITHIN CITY COUNCIL-APPROVED EXPENDITURE AUTHORITY; AND FURTHER AUTHORIZING THE CITY CONTROLLER TO DISBURSE FUNDS.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PHOENIX as follows:
SECTION 1. The City Manager, or his designee, is authorized to rescind the award to Clayco Inc. and to accept and execute an agreement with M.A. Mortenson Co. to provide construction manager at risk preconstruction and construction services for the Phoenix Sky Harbor International Airport Terminal 4 Infrastructure North Concourse 4 Passenger Boarding Bridges Replacement project. The term of the agreement is five years from issuance of the Notice to Proceed. Work scope identified and incorporated into the agreement prior to the end of the term may be agreed to by the parties, and work may extend past the termination of the agreement. No additional changes may be executed after the end of the term. The agreement value will not exceed fifteen million ($15,000,000), including all subcontractor and reimbursable costs. Payments may be made up to agreement limits for all rendered agreement services, which may extend past the agreement termination.
SECTION 2. The City Manager, or his designee, is authorized to execute amendments to the agreement as necessary within City Council-approved expenditure authority.
SECTION 3. The City Controller is authorized to disburse funds for purposes of this Ordinance.
