ORDINANCE S-52448 AN ORDINANCE AUTHORIZING THE ACQUISITION OF EASEMENTS BY DONATION, PURCHASE WITHIN THE CITY'S APPRAISED VALUE, PURCHASE AT A SETTLEMENT AMOUNT ARRIVED THROUGH MEDIATION, OR BY THE POWER OF EMINENT DOMAIN, FOR BASIN 5 - CIRCLE K PARK PROJECT LOCATED SOUTH OF EUCLID AVENUE, BETWEEN 7TH AND 14TH STREETS; AND FURTHER AUTHORIZING THE CITY CONTROLLER TO DISBURSE ALL FUNDS FOR THE PURPOSES OF THIS ORDINANCE. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PHOENIX as follows: SECTION 1: The City Manager, or his designee, is authorized to acquire easements for the Basin 5 - Circle K Park Project South of Euclid Avenue, between 7th and 14th streets by a separate recording instrument. The parcels affected by this project are located at 1307 E. Pedro Drive (the “Subject Property”). SECTION 2: The Subject Property shall be acquired through donation, purchase within the City’s appraised value, purchase at a settlement amount arrived through mediation and determined by the City Manager or designee to be reasonable under the circumstances, or by the power of eminent domain. SECTION 3: The City Controller is authorized to disburse all related funds in furtherance of the purposes of this Ordinance.
