REAL PROPERTY ON SPECIAL
EXECUTION AND ORDER OF SALE
UNDER AND BY VIRTUE OF EXECUTION AND ORDER OF SALE issued out of and under the seal of Superior Court of Maricopa County, State of Arizona, on the 15th day of October, 2025, and to me as Sheriff of said County duly directed and delivered in the above entitled action:
WHEREAS, on the 20th day of December, 2024 and the 8th day of July, 2025, the above-named Plaintiff recovered a Judgment in the above-styled Court against the Defendants, Phuong Le and Loan Tran, as follows:
For the principal amount of $7,895.98 plus accruing assessments of $106.43 monthly or such greater amount as Recker Pointe may assess in the future as a lien on the Property, accruing administrative fees of $20.00 month, accruing late fees of $15.00 month together with interest thereon at the rate of 12% per annum from the date the judgment until paid in full; For Recker Pointe Community Association’s reasonable attorneys’ fees in the amount of $6,931.20 and court costs in the amount of $1,420.59, together with interest thereon at the rate of 8.5% per annum from the date of judgment until paid in full against Defendant Loan Tran; For pre-judgment interest on the principal amount at the rate of 12% in the amount of $947.52; For pre-judgment interest on the principal amount at the rate of 12% in the amount of $1,015.27; For Recker Pointe Community Association’s reasonable attorneys’ fees, costs and expenses incurred in executing upon the Judgment including, but not limited to, all attorneys’ fees, costs and expenses incurred in scheduling and conducting the sale and, if necessary, obtaining possession of the Real Property, recording any subsequent deed, and costs to repair and sell the Real Property, upon application to the court, in satisfaction of all amounts due to the Recker Point Community Association presently in the amount of $17,996.88. This amount was reached by adding the judgment amount of $17,195.29, post-Judgment assessment of $319.29, post-Judgment administrative fee of $60.00, and post-Judgment interest of $422.30 to October 9, 2025, plus costs of Sheriff’s Sale, together with a foreclosure of Plaintiff’s lien against the Defendants, on the following described real property, to-wit:
Lot 3231, of RECKER POINTE – PHASE 2, according to plat of record in the office of the County Recorder of Maricopa County, Arizona recorded in Book 1355 of Maps, Page 38.
AKA: 1707 S. Wallrade Ln., Gilbert, Arizona 85295.
NOW, THEREFORE, PUBLIC NOTICE IS HEREBY GIVEN that on the 8th day of January, 2026, at the hour of 10:00 A.M. at 301 West Jefferson Street, Room 250-8*, in the City of Phoenix, Maricopa County, State of Arizona, I will in obedience to said Execution and Order of Sale, sell all the right, title, claim and interest of the above named debtor, in, of and to the above described property at public auction to the highest bidder for cash or certified funds only, in lawful money of the United States, and apply the proceeds thereof to the payment and satisfaction of said judgment, together with the interest that may be due thereon and all costs of suit and accruing costs.
