NOTICE
Notice is hereby given that Borough Council for the Borough of Waynesboro, Franklin County, Pennsylvania, intends to consider for adoption and to vote upon the enactment of four (4) proposed ordinances as summarized below at the reorganization meeting of Borough Council on Monday, January 5, 2026, at 6:30 P.M., in the second floor Council Chambers of Borough Hall located at 55 East Main Street, Waynesboro, Pennsylvania.
The title of the first proposed ordinance is as follows: "AN ORDINANCE OF THE BOROUGH OF WAYNESBORO, FRANKLIN COUNTY, PENNSYLVANIA, AMENDING CHAPTER 195 OF THE CODE OF THE BOROUGH OF WAYNESBORO BY AMENDING THE DEFINITION OF TRANSIENT RETAIL BUSINESS."
If enacted, the proposed ordinance will amend Chapter 195 of the Code of the Borough of Waynesboro (the "Code"), entitled "Peddling and Soliciting," by amending the definition of "Transient Retail Business" to include selling, soliciting, or taking orders upon any streets or alleys, or public grounds regardless of whether the person has a physical location (brick and mortar establishment) in the Borough of Waynesboro.
The title of the second proposed ordinance is as follows: "AN ORDINANCE OF THE BOROUGH OF WAYNESBORO, FRANKLIN COUNTY, PENNSYLVANIA, AMENDING CHAPTER 178 OF THE CODE OF THE BOROUGH OF WAYNESBORO TO PROVIDE FOR THE REGULATION AND PERMITTING OF SPECIAL EVENTS."
If enacted, the proposed ordinance will amend Chapter 178 of the Code, currently entitled "Parades," to include special events conducted in the Borough of Waynesboro. The proposed ordinance will establish regulations and require permits for special events, which includes all assemblies of people for the purpose of business or public amusement or entertainment, reasonably anticipated to number 100 or more participants or spectators for a continuous period of 30 minutes or more, where participants or spectators at the special event will use public roads or public property.
The title of the third proposed ordinance is as follows: "AN ORDINANCE OF THE BOROUGH OF WAYNESBORO, FRANKLIN COUNTY, PENNSYLVANIA, AMENDING PROVISIONS OF THE CODE OF THE BOROUGH OF WAYNESBORO TO: (1) PROVIDE THAT FINE AMOUNTS ISSUED FOR TICKETS FOR VIOLATIONS OF CHAPTER 167, ENTITLED "NUISANCES", CHAPTER 201, ENTITLED "PROPERTY MAINTENANCE", AND CHAPTER 245, ENTITLED "STREETS AND SIDEWALKS", SHALL BE SET FORTH IN AMOUNTS AS ESTABLISHED BY RESOLUTION OF THE BOROUGH COUNCIL OF THE BOROUGH OF WAYNESBORO; AND (2) ESTABLISH FIRST CLASS MAIL WITH A CERTIFICATE OF MAILING AND POSTING TO THE PROPERTY AS AUTHORIZED METHODS OF SERVICE FOR NOTICES OF VIOLATION OF THE PROPERTY MAINTENANCE ORDINANCE OF THE BOROUGH OF WAYNESBORO."
If enacted, the proposed ordinance will amend the Code to provide that fine amounts issued for tickets for violations of certain provisions of Chapter 167, entitled "Nuisances", Chapter 201, entitled "Property Maintenance", and Chapter 245, entitled "Streets and Sidewalks", shall be set forth in amounts as established by resolution of the Borough Council. The proposed ordinance will also amend the authorized methods of service for violation notices of the Property Maintenance Ordinance of the Borough of Waynesboro to include service by first-class mail with a certificate of mailing and posting to the subject property.
The title of the fourth proposed ordinance is as follows: "AN ORDINANCE OF THE BOROUGH OF WAYNESBORO, FRANKLIN COUNTY, PENNSYLVANIA, REGULATING THE USE OF MICROMOBILITY DEVICES ON SIDEWALKS WITHIN THE BOROUGH."
If enacted, the proposed ordinance will amend the Code of the Borough of Waynesboro (the "Code"), entitled "Micromobility Devices," which will regulate the use of micromobility devices on sidewalks in the Borough of Waynesboro. If enacted, the proposed ordinance will also amend the Code by repealing Chapter 226, entitled "Skateboards, Skates and Rollerblades."
The summary contents of the ordinance are:
SECTION 1: Amends the Code by repealing Chapter 226, entitled "Skateboards, Skates and Rollerblades," in its entirety.
SECTION 2: Amends the Code by adding a new Chapter 159, entitled "Micromobility Devices," which defines various terms related to micromobility devices, prohibits the use of micromobility devices on certain sidewalks in the Borough of Waynesboro, and regulates the use of micromobility devices on sidewalks in general.
SECTION 3: Repealer.
SECTION 4: Savings Clause.
SECTION 5: Severability.
SECTION 6: Effective Date.
