NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the County of Morris (County).
REQUEST FOR RELEASE OF FUNDS
On or about January 7, 2026, the County will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of federal Home Investment Partnership Program (HOME) funds under Title II of the Cranston-Gonzalez National Affordable Housing Act of 1990 (Act), as amended, to be undertake the following activities:
Morris Habitat for Humanity West Dewey Affordable Housing - The property site consists of four vacant lots owned by Roxbury Township. The project consists of the new construction of 6 homes for low- and moderate-income households. The homes are based on Morris Habitat's proprietary prototype architectural design. Each home will have a driveway and an attached one-car garage. The six dwellings will be individually metered for utilities, except for water and sewer. This area of Roxbury Township is not served by public water or sanitary sewer. The project engineer has designed two potable wells and two septic systems that will be shared by the six homes. These utilities shared between the homeowners will be addressed with a Declaration of Covenants and Restrictions. In addition, each unit will have a range, refrigerator, washer, and dryer. All of Morris Habitat's homes are Energy Star Certified, and most are built to LEED standards. Green or reusable materials will be used whenever possible. New Home Warranties will be provided for all six homes.

FINDING OF NO SIGNIFICANT IMPACT (FONSI)
The County has determined that the projects listed above will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act (NEPA) of 1969 is not required. Additional project information is contained in the Environmental Review Record (ERR) on file with Morris County and can be accessed in the Community Development Office at 1 Medical Center Drive, Morris Plains, NJ, 07950, Monday to Friday, 8:30AM to 4:30PM. PUBLIC COMMENTS
Any individual, group or agency may submit written comments on the ERR to Lauren Van Horne, Morris County Community Development Programs, PO Box 900, Morristown, NJ 07963, or by email lvanhorne@co.morris.nj.us. All comments received by January 6, 2026 will be considered by the County prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
ENVIRONMENTAL CERTIFICATION
The County of Morris certifies to HUD that Tayfun Selen, Certifying Officer, in his capacity as Director of the Morris County Board of Commissioners, consents to accept the jurisdiction of the federal courts if an action is brought to enforce responsibilities in relation to the environmental review process, and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the County to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD will accept objections to its release of funds and the County’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the County; (b) the County has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted via email in accordance with the required procedures (24 CFR Part 58, Sec. 58.76), and shall be addressed to the Newark Field Office of Community Planning and Development (CPD), by email to CPDRROFNJN@hud.gov Potential objectors should contact HUD Newark via email to verify the actual last day of the objection period.
