MORTGAGEE’S NOTICE OF SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain Mortgage given by James F. O'Connell and Suzanne O'Connell to Baycoast Bank, dated June 27, 2016 and recorded with the Bristol County (Fall River District) Registry of Deeds at Book 8987, Page 90, subsequently assigned to Mortgage Electronic Registrations Systems, Inc. ("MERS"), its successors and assigns by BayCoast Bank by assignment recorded in said Bristol County (Fall River District) Registry of Deeds at Book 11414, Page 325, subsequently assigned to PNC Bank, National Association by Mortgage Electronic Registration Systems, Inc., as Mortgagee by assignment recorded in said Bristol County (Fall River District) Registry of Deeds at Book 11694, Page 27 for breach of the conditions of said Mortgage and for the purpose of foreclosing same will be sold at Public Auction at 1:00 PM on January 12, 2026 at 1810 Highland Avenue, Unit #1A, Fall River, MA, all and singular the premises described in said Mortgage, to wit:
Unit No. 1A (the "Unit"), a unit in the condominium in "Fall River, Bristol County, Massachusetts, known as the Shires of Highland Condominium (the Condominium"), created pursuant to and subject to the provisions of Chapter 183A of the General Laws of Massachusetts, by Master Deed dated August 29, 1990 and recorded with the Bristol County Registry of Deeds (hereinafter referred to as the "Deeds"), on September 20, 1990 in Book 2264, Page 148 (hereinafter referred to as the "Master Deed").
The Post Office address of the Unit is: Unit 1A, 1810 Highland Avenue, Fall River, MA 02720
The Unit is conveyed together with:
A. An undivided 4.009% interest appertaining to the Unit in the common areas and facilities of the Condominium (subject, however, to revision of that undivided percentage interest pursuant to the term of Section 10 of the Master Deed);
B. The exclusive right and easement to use Parking Space Nos. 1 and 2, as shown on the plan entitled, "The Shires of Highland Condominium, Phases I & II, 1810 Highland Avenue, Fall River, Bristol Co., Mass. Consisting of Sheet 1 of 17 sheets" prepared by Tibbetts Engineering Corp., dated August 16, 1990 and recorded with the Master Deed; and
C. As appurtenant to the Unit, the exclusive right and easement, exercisable and subject to and in accordance with the provisions of the Master Deed, The Shires of Highland Condominium Trust under Declaration of trust dated August 29, 1990 and recorded with the Deeds in Book 2264, Page 121, (hereinafter referred to as the "Condominium Trust") and the rules and regulations promulgated pursuant thereto, to use: (i) the driveway leading to such Unit's garage if any and walkways of Highland Condominium Phases I & II, 1810 Highland Avenue, Fall River, Bristol Co., Mass. Consisting of sheet 1 of 17 Sheets, prepared by Tibbetts Engineering Corp., dated August 16, 1990 and recorded with the Master Deed (the "Site Plan") (ii) with respect to Unit Types A, B and C (flat Units), two (2) parking spaces located as shown on the Site Plan as designated of the first deed of the Unit by the Declarant; and (iii) the stairway landing, front porch and/or balcony, if any, to which such Unit has direct and immediate access. If shown on the Site Plan, the Unit shall use the yard or the rear of side of such Unit, as demarcated for those Units on the Site Plan. Each type A Unit (upper level flat) shall have the exclusive right and easement, exercisable as set forth herein, to use the exterior stairway leading from the Unit exit to the building front porch and each Type B Unit (middle level flat) and Type C Unit shall have the right and easement, in common with others, exercisable as set forth herein to use the landing at the bottom of the interior stairway leading to the building front porch.
The Unit is shown on the floor plans prepared by The Architectural Team, Inc., and bearing the verified statement of a registered architect, which plans are recorded with the Master Deed (herein referred to as the "Plans").
Subject to and together with the benefit of, as the case may be, other terms conditions, covenants, restrictions, exceptions, easements, limitations, reservations, powers of attorney, lien rights, provisions and charges, as set forth and described in said deed.
Being the same premises conveyed to this mortgagor by deed of Nancy B. Leary, Trustee of the Hilda S. O'Connell Revocable Trust u/d/t dated October 2, 1997 to be executed and recorded concurrently herewith.

The premises are to be sold subject to and with the benefit of all easements, restrictions, encroachments, building and zoning laws, liens, unpaid taxes, tax titles, water bills, municipal liens and assessments, rights of tenants and parties in possession, and attorney’s fees and costs.
TERMS OF SALE:
A deposit of FIVE THOUSAND DOLLARS AND 00 CENTS ($5,000.00) in the form of a certified check, bank treasurer’s check or money order will be required to be delivered at or before the time the bid is offered. The successful bidder will be required to execute a Foreclosure Sale Agreement immediately after the close of the bidding. The balance of the purchase price shall be paid within thirty (30) days from the sale date in the form of a certified check, bank treasurer’s check or other check satisfactory to Mortgagee’s attorney. The Mortgagee reserves the right to bid at the sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney. The description of the premises contained in said mortgage shall control in the event of an error in this publication. TIME WILL BE OF THE ESSENCE.
