NOTICE OF MORTGAGEE’S SALE OF REAL ESTATE
By virtue, and in execution of the Power of Sale contained in a certain mortgage given by 89 West Street LLC to David Walch, Trustee of the Athens Street Capital Realty Trust 1 u/d/t dated February 13, 2023 and recorded with the Worcester County Registry of Deeds in Book 71776 at Page 1. The mortgage is dated August 11, 2023, and recorded with the in Worcester County Registry of Deeds in Book 69507 at Page 4 and is confirmed by Confirmatory Mortgage dated June 24, 2025 and recorded at the Worcester Registry of Deeds at Book 72497, Page 372 of which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 11 o’clock A.M. on the 21st day of January 2026, at 89 West Main Street, Northborough, Worcester County, Massachusetts, all and singular the premises described in said mortgage.

The land in Northborough, Worcester County, Commonwealth of Massachusetts, with the buildings thereon, situated on the southerly side of Main Street, also known as
Boston Post Road, in said Northborough, bounded and described as follows:
Beginning at the northwesterly corner of the premises by land now or formerly of one Stuart C. Burnett; Thence proceeding westerly along said southerly line of Main Street, approximately 135.00 feet to an iron stake at land now or formerly of one Moulton; Thence South 6º East, by Moulton land, a distance of 300 feet; Thence easterly by a line parallel with the said southerly line of Main Street and of the land of said Moulton, a distance of 135.00 feet to said Burnett land; Thence North 6º West, by said Burnett land, 300.00 feet to the place of beginning.
For title see deed recorded with said deeds at Book 61038, Page 130. Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
Terms of sale: A deposit of Five Thousand dollars ($5,000) by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at the Law Offices of Melia & Osol, 16 Harvard Street, Worcester, MA 01609 within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. In the event of an error in this publication, the description of the premises contained in said mortgage shall control.
