MORTGAGEE'S SALE OF REAL ESTATE
By virtue of and in execution of the Power of Sale contained in a certain mortgage given by James Holloway and Beverly Holloway to Financial Freedom Senior Funding Corporation, a Subsidiary of Indy Mac Bank, F.S.B., dated April 17, 2008 and recorded in Plymouth County Registry of Deeds in Book 35874, Page 328 (the “Mortgage”) of which mortgage PHH Mortgage Corporation is the present holder by Assignment from Financial Freedom Senior Funding Corporation to Mortgage Electronic Registration Systems, Inc., its successors or assigns, as nominee for Financial Freedom Acquisition LLC dated September 25, 2009 and recorded at said Registry of Deeds in Book 37815, Page 178, and Assignment from Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Financial Freedom Acquisition LLC, its successors and assigns to Mortgage Assets Management, LLC dated March 22, 2024 and recorded at said Registry of Deeds in Book 58765, Page 213, and Assignment from Mortgage Assets Management, LLC to PHH Mortgage Corporation dated August 7, 2025 and recorded at said Registry of Deeds in Book 60227, Page 95, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 267 Main Street, Kingston, MA 02364 will be sold at a Public Auction at 2:00 PM on January 12, 2026, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
A certain parcel of land, together with the buildings thereon, in Kingston, Plymouth County, Massachusetts, bounded and described as follows:
Beginning at a point in the northerly sideline of Main Street in said Kingston, it being the southeasterly corner of land now or formerly of one Davis, and the southwesterly comer of the land herein described.
Thence easterly in the northerly sideline of Main Street, ninety (90) feet to a corner of land now or formerly of one Cobb;
Thence, northerly in line of said Cobb land and in line of land now or formerly of one McCarthy, two hundred fifty (250) feet to a point;
Thence, westerly in line of land now or formerly of Donald Davis to the southwesterly corner of land now or formerly of said Davis, ninety-five (95) feet, more or less; and
Thence, turning and running in a straight line, two hundred fifty (250) feet southerly to the point of beginning in the northerly sideline of said Main Street.
For mortgagor’s title see deed recorded with the Plymouth County Registry of Deeds in Book 23695, Page 58.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee. The description for the premises contained in said mortgage shall control in the event of a typographical error in this publication.
