ORDINANCE NO. 1154
AN ORDINANCE AMENDING THE JOHNSTON REVISED ORDINANCES OF 2007 BY AMENDING THE OFFICIAL ZONING MAP TO REZONE 0.81 Acres From R-1(100), Large Lot Residential District to C-1, Neighborhood Commercial District with Conditions.
WHEREAS, the Planning and Zoning Commission reviewed this item at their regular meeting on October 27th, 2025, and recommends approval of the proposed rezoning, subject to conditions.
NOW THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF JOHNSTON, IOWA THAT:
SECTION 1. PURPOSE. The purpose of this ordinance is to change the Official Zoning Map of the City of Johnston, Iowa, under the provisions of Chapters 165 to 190 (Zoning Ordinance), Chapter 166 (General Provisions), Section 167.02 (District Boundaries and Official Zoning Map) of the Johnston Municipal Code.
SECTION 2. OFFICIAL ZONING MAP AMENDED FROM R-1(100), Large Lot Residential District to C-1, Neighborhood Commercial District with Conditions. The following legally described property is hereby rezoned from R-1(100), Large Lot Residential District to C-1, Neighborhood Commercial District with Conditions:
Lot 8 in Ralles-Acres, an Official Plat now included in and forming a part of the City of Johnston, Polk County, Iowa, EXCEPT the real property described in the Acquisition Plat recorded in Book 19869 Page 855 of the Polk County Recorder's Office
SECTION 3. CONDITIONS. No uses other than those listed below, as defined by Chapter 165.02 of the Municipal Code, shall be allowed on the property. In no case shall the sales of alcohol, tobacco, and vaping products be permitted on the property.
i. Specialty Coffee and Food Store
ii. Small Standalone Store, Retail, or Service
These conditions are hereby agreed to by the undersigned property owner.

SECTION 4. REPEALER. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.
SECTION 5. SEVERABILITY CLAUSE. If any section, provision, or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.
SECTION 6. WHEN EFFECTIVE. This ordinance shall be in full effect from and after its final passage, approval, and publication as provided by law.
