NOTICE OF SALE UNDER POWER
Because of a default under the terms of the Security Deed executed by Adrine Waltower Downs to EquiCredit dated August 24, 2000, and recorded in Deed Book 00699, Page 1288, and re-recorded in Deed Book 00710, Page 1095, Richmond County Records, said Security Deed having been last sold, assigned, transferred and conveyed to U.S. Bank Trust Company, National Association, as Trustee, as successor-in-interest to U.S. Bank National Association, not in its individual capacity but solely as indenture trustee, for the holders of the CIM Trust 2021-R4, Mortgage-Backed Notes, Series 2021-R4, securing a Note in the original principal amount of $55,533.15, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, February 3, 2026, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit:
ALL THAT LOT OR PARCEL OF LAND with improvements thereon, situate, lying and being in the State of Georgia, County of Richmond, being known and designated as Lot 12, fronting a distance of 66.0 feet on the Northernmost side of Vandivere Road and extending back therefrom on its Easternmost boundary line a distance of 168.0 feet and on its Westernmost boundary line a distance of 182.0 feet to a rear width of 53.00 feet, as shown on a plat thereof recorded in the Office of the Clerk of the Superior Court of Richmond County, Georgia, in Realty Book 17-O at page 145; reference is made to said plat for a more complete and accurate description as to metes, bounds, and location of said property.
Said property is conveyed subject to restrictions and to any easements of record in said clerk's office.
Said property is further known under the present system of house numbering in Richmond County, Georgia, as 2117 Vandivere Road, Augusta, Georgia.
INCLUDED IN THE ABOVE CONVEYANCE BUT EXCLUDED DUE TO PARTIAL RELEASE RECORDED NOVEMBER 17, 2025 IN BOOK 1991 PAGE 2133:
ALL THAT LOT OR PARCEL OF LAND with improvements thereon, situate, lying and being in the State of Georgia, County of Richmond, being known and designated as Lot 13, and fronting a distance of 66.0 feet on the North side of Vandivere Drive and extends back therefrom between converging lines a distance of 168.0 feet on the Western boundary and a distance of 145.0 feet on its Eastern boundary to a rear width of 57.0 feet on its northern boundary as shown on a plat thereof recorded in said clerks' office in Realty Book 17 O at page 145; reference is made to said plat for a more complete and accurate description as to metes, bounds, and location of said property.
Said property is subject to any restrictions and to any easements of record.
Said property is further known under the present system of house numbering in Richmond County, Georgia, as 2115 Vandivere Road, Augusta, Georgia.
Said property is known as 2117 Vandivere Road, Augusta, GA 30904, together with all fixtures and personal property attached to and constituting a part of said property, if any.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor.
The property is or may be in the possession of The Representative of the Estate of Adrine Waltower Downs, successor in interest or tenant(s).
