NOTICE OF PUBLIC
HEARING ON PROPOSED CHANGES
TO THE GENERAL BYLAW SECTION 32050
STORMWATER
SCITUATE PLANNING BOARD
Notice is hereby given that a Public Hearing will be held by the Scituate Planning Board on Thursday, January 8, 2026 at 7:00 P.M. in the Select Board Hearing Room, Scituate Town Hall, 600 Chief Justice Cushing Highway to consider amendments and changes to the Scituate General Bylaw Section 32050 as described below. These amendments and changes will appear together as an article on the Warrant for the Annual Town Meeting commencing on April 13, 2026. All references below refer to sections of the Stormwater General Bylaw.
Proposed changes to the Town of Scituate General Bylaws, Section 32050 Stormwater include:
1. Under Section 2, Purpose, add clarification language for NPDES and the MS4 Permit under the Clean Water Act.
2. Under Section 3, Definitions, add definitions for MS4 compliance and for coordination with the Stormwater Regulations adopted October 27, 2025.
3. Under Section 4, Applicability:
A. Add language for MS4 compliance.
B. Change thresholds so all new development on a vegetated lot requires a permit; minor wording changes in applicability with net increase in impervious area being defined;
C. Minor changes to wording in exempt activities;
D. Add requirements for projects meeting 80% thresholds;
E. Add language for Projects in the Water Resource Protection District.
4. Under Section 5, Administration, minor changes in wording with Permitting Authority being changed to Stormwater Authority.
5. Under Section 6, Adoption of Regulations, change shall to may in Section A.
6. Under Section 7, Submittal Requirements, delete submittal requirements that are in Stormwater Regulations to avoid repetition.
7. Under Section 8, Performance Standards, Add MS4 requirements and delete requirements in the Stormwater Regulations.
8. Under Section 9, Review Process, add requirements for a preconstruction meeting and clarify requirements for a public hearing. Change Permitting Authority to Stormwater Authority. Add language for appeals to make it consistent with regulations.
9. Under Section 10, Notifications, Inspections, clarify inspections done by Stormwater Authority or its representative.
10. Under Section 10, Submittal of as-built plans, change wording that specifications for as- built plans may be outlined in the Stormwater Regulations.
11. Under Section 12, Surety, add more details on surety.
12. Under Section 13. Enforcement, change Permitting to Stormwater Authority, add language that the Permitting Authority may issue a Stop Work Order.
The text of the current Stormwater General Bylaw and the complete text of the proposed amendments to the Stormwater General Bylaw are available for inspection during the normal business hours of the Scituate Town Hall at the offices of the Town Clerk and the Planning Board at 600 Chief Justice Cushing Highway, Scituate, Massachusetts. Any person wishing to comment on the proposed general bylaw amendment should appear at the public hearing at the time and place indicated above. Written comments on the general bylaw amendment will also be accepted by the Planning Board prior to the public hearing.
