NOTICE OF PUBLIC HEARING ON PROPOSED CHANGES
TO THE ZONING BYLAW
SCITUATE PLANNING BOARD
Notice is hereby given pursuant to M.G.L. Chapter 40A Section 5 that a Public Hearing will be held by the Scituate Planning Board on Thursday, January 8, 2026 at 6:30 P.M. in the Select Board Hearing Room, Town Hall, 600 Chief Justice Cushing Highway, Scituate, Massachusetts, to consider amendments to the Scituate Zoning Bylaw as described below. These amendments will appear as articles on the Warrant for the Annual Town Meeting commencing April 13, 2026. All references below to Sections refer to Sections of the Zoning Bylaw.
1. Amendment to Section 200 – Definitions. Proposed change includes:
A. Adding a new definition for Modular Dwelling Unit.
B. Amending definition of Impervious Surface.
2. Amendments to Section 420 – Table of Use Regulations. Proposed
changes include:
A. Amend Section 420 to change in Section 1:
• A.1 Single-family attached dwelling from Y to N in DBP district;
• B. Two-family dwelling subject to S 430.1 add & VCN and change N to Y in NRN district;
• D. Accessory Dwelling subject to Section 530 add Y to R-1, R-2, R-3 and B districts;
• M. Child care facility Change N to Y in NRCR and DCR districts;
• N. Live/Work Building change Y to N in NRN district and SP to N in the DBP district;
• O. Mixed-Use Building add SP to B and change Y to N in NRN district and SP to N in the DBP district.
3. Amendment to Section 450 – Special Provisions Applicable To All Districts. Proposed changes include:
A. Add a new Section 450.5 for Construction Site Preparation Standards to include no site work shall begin until all permits received and storage of materials is incidental to site preparation work
4. Amendments to Section 520 – Water Resource Protection District.
Proposed changes include:
A. Amend Section 520.4 Buffer Zone to clarify non-disturbance buffer zone sources and removal of invasive species.
5. Amendments to Section 580 – Village Center and Neighborhood District
Proposed changes include:
A. Amend Table 1- Allowed Building Types in the VCN District to change 2. Cottage and Cottage Court from a Y to N in the NDTV district and change SP to N in the DBP district for 6. Live/Work Building and 7. Mixed Use Building.
6. Amendments to Section 600 – Dimensional Regulations
Proposed changes include:
A. Amend 610.1 Lot Area and Width Requirements paragraph A. to say “all required lot area must be contiguous.” Change B. from buildable lot area to required lot area.
B. Amend Section 620.1 Building Heights to clarify maximum building height in residential districts is 40 feet and, in the B and VCN districts is 45 feet.
C. Amend Section 620.3 Setback and Yard Requirements to change the Required Rear Yard Depth in the R-1 and R-2 District from 8 feet to 15 feet.
D. Amend 620.4 Modifications and Exceptions to add a new subsection D. for construction of patios, driveways, walkways, pool decks at grade and more than 30” above grade extending into the setback.
The text of the current Zoning Bylaw, the current Zoning Map, the complete text of the proposed amendments to the Zoning Bylaw are available for inspection during the normal hours of business of the Scituate Town Hall at the offices of the Town Clerk and the Planning Board at Town Hall, 600 Chief Justice Cushing Highway, Scituate, Massachusetts and on the Town of Scituate website on the Planning Board web page under proposed bylaw changes. Any person wishing to comment on these proposed zoning amendments should appear at the public hearing at the time and place designated above. Written comments on the zoning amendments will also be accepted by the Planning Board prior to the public hearing.
