ORDINANCE NO. 2974 AN ORDINANCE OF THE COMMON COUNCIL OF THE TOWN OF GILBERT, ARIZONA, AMENDING THE CODE OF GILBERT, ARIZONA, CHAPTER 10 BUILDINGS AND CONSTRUCTION REGULATIONS, ARTICLE VI PUBLIC WORKS, SECTION 10-202 ADOPTION OF TOWN OF GILBERT'S PUBLIC WORKS AND ENGINEERING STANDARDS, SUPPLEMENT TO MAG UNIFORM STANDARD DETAILS FOR PUBLIC WORKS CONSTRUCTION, AND THE SUPPLEMENT TO MAG UNIFORM STANDARD SPECIFICATIONS FOR PUBLIC WORKS CONSTRUCTION; ADOPTING BY REFERENCE MODIFICATIONS TO THE PUBLIC WORKS AND ENGINEERING STANDARDS, SUPPLEMENT TO MAG UNIFORM STANDARD DETAILS FOR PUBLIC WORKS CONSTRUCTION AND SUPPLEMENT TO MAG UNIFORM STANDARD SPECIFICATIONS FOR PUBLIC WORKS CONSTRUCTION SETTING AN EFFECTIVE DATE OF JANUARY 16, 2026; PROVIDING FOR THE REPEAL OF CONFLICTING ORDINANCES; PROVIDING FOR SEVERABILITY; AND PROVIDING PENALTIES WHEREAS, the Town Council previously adopted the Public Works and Engineering Standards Manual, the Supplement to MAG Uniform Standard Details for Public Works Construction, the Supplement to MAG Uniform Standard Specifications for Public Works Construction as amended; and WHEREAS, Town staff is recommending various revisions and addition to these documents to clarify and improve certain elements of these documents; NOW THEREFORE, BE IT ORDAINED by the Common Council of the Town of Gilbert, Arizona, as follows: Section 1. The Code of Gilbert, Arizona, Chapter 10 Buildings and Construction Regulations, Article VI Public Works, Section 10-202 Adoption of Town of Gilbert's public works and engineering standards; supplement to MAG uniform standard details for public works construction; and supplement to MAG uniform standard specifications for public works construction, is hereby amended to read as follows (additions in ALL CAPS; deletions in strikeout): Sec. 10-202. These certain documents three copies of which are on file in the office of the clerk, being marked and designed as Town of Gilbert’s “Public Works and Engineering Standards” (January 17, 2025 JANUARY 16, 2026); “Supplement to MAG Uniform Standard Details for Public Works Construction” (January 17, 2025 JANUARY 16, 2026); and “Supplement to MAG Uniform Standard Specifications for Public Works Construction” (January 17, 2025 JANUARY 16, 2026), published by the town, together with all appendices thereto, are hereby adopted as the engineering standards of the town, and as a supplement to the standard details for public works construction of the town, and such code supplement is hereby referred to, adopted and made a part of this chapter as through set forth fully in this section. Section 2. These certain documents three copies of which are on file in the office of the clerk, being marked and designed as Town of Gilbert’s "Public Works and Engineering Standards (effective January 16, 2026)”; "Supplement to MAG Uniform Standard Details for Public Works Construction (effective January 16, 2026)”; and “Supplement to MAG Uniform Standard Specifications for Public Works Construction (effective January 16, 2026), published by the town, together with all appendices thereto, are hereby adopted as the engineering standards of the town, and as a supplement to the standard details for public works construction of the town, and such code supplement is hereby referred to, adopted and made a part of this chapter as though set forth fully in this section. Section 3. That certain document dated January 16, 2026 and entitled “Public Works and Engineering Standard (effective January 16, 2026)”, “Supplement to MAG Uniform Standard Details for Public Works Construction (effective January 16, 2026)”and “Supplement to MAG Uniform Standard Specifications for Public Works Construction (effective January 16, 2026), three copies of which are on file in the office of the Town Clerk, is hereby declared to be a public record, and said copies are ordered to remain on file with the Town Clerk. Section 4. All ordinances and parts of ordinances in conflict with this ordinance are hereby repealed, effective as of January 16, 2026. Section 5. If any section, subsection, sentence, clause, phrase or portion of this ordinance or any part thereof adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof. Section 6. Any person found responsible for violating this Ordinance shall be subject the civil sanctions and habitual offender provisions set forth in Section 1-5 of the Gilbert Municipal Code. Each day a violation continues, or the failure to perform any act or duty required by the Municipal Code or by the Town of Gilbert Municipal Court continues, shall constitute a separate civil offense.
