NOTICE OF SALE OF COOPERATIVE
APARTMENT SECURITY BY VIRTUE OF A DEFAULT
PLEASE TAKE NOTICE: By virtue of a default under a Loan Security Agreement dated February 19, 2019, executed by debtors Maylene Martinez and Jason Vasquez to Loandepot.com, LLC, as assigned to Wilmington Savings Fund Society, FSB, as Owner Trustee of the Residential Credit Opportunities Trust X-B, said secured party, by Terrence Gee, John William O’Keefe or Michael Campbell will conduct a public sale of the security consisting of 701 shares of stock of Westwater Commons Corp., all right, title, and interest in and to a Proprietary Lease between said Corporation and debtor(s) for APARTMENT 4A IN BUILDING KNOWN 380 North Broadway, Unit 4A, Yonkers, New York 10701, with an estimated value of $360,000.00. Together with all fixtures and articles of personal property now or hereafter affixed to or used in connection with said apartment on January 20, 2026, at 11:15 A.M. on the front steps of the Front Steps of the Westchester County Supreme Court, 111 Dr. Martin Luther King Jr. Boulevard, White Plains, New York 10601in satisfaction of an indebtedness in the unpaid principal amount of $160,301.19, plus interest, late fees, attorney fees, maintenance in arrears, and all other advanced charges.
Notice is hereby being given to Maylene Martinez and Jason Vasquez that:
• Pursuant to section 9-623 of the Uniform Commercial Code Maylene Martinez and Jason Vasquez have a statutory right to redeem the collateral by tendering fulfillment of all obligations secured by the collateral, including reasonable expenses and attorney’s fees, at any time before a secured party has collected the collateral, disposed of the collateral or entered into a contract for its disposition, or has accepted collateral in full or partial satisfaction of the obligation it secures;
• Payment of the debt is due in full by January 19, 2026;
• Maylene Martinez interests in and rights to APARTMENT 4A IN BUILDING KNOWN 380 North Broadway, Unit 4A, Yonkers, New York 10701 are being sold and risk being terminated;
• If Maylene Martinez, Jason Vasquez, or any person(s) has a dispute of validity of the lien or amount claimed herein, it may be brought to proceeding under Lien Law, Section 201-a, within 10 days of the service of this notice.
• Maylene Martinez and Jason Vasquez are entitled to an accounting of the unpaid indebtedness upon request.
The apartment is sold "AS IS" AND POSSESSION TO BE OBTAINED BY THE PURCHASER.
Said sale is subject to payment of all sums due, if any, to Westwater Commons Corp., and the consent if necessary, of said corporation; any existing tenancy; payment of all expenses and fees of the secured party with respect thereto; terms of sale and auctioneer's fees; flip-tax; State, City, and County transfer tax. The secured party reserves the right to bid.
Terms: an official bank or certified check made payable to Friedman Vartolo LLP, as attorneys for the secured party for ten (10%) percent of price bid. No cash accepted. Balance shall be due within thirty (30) days. The Auctioneer’s fees are required at sale.
