pursuant to §7-725-a of the Village Law requesting area variances in connection with the Applicant's application for subdivision and site plan approval for a seven (7) lot townhouse development as permitted by Village Code § 110-19.1 B (1) (o). The property involved is known as 461 Lexington Avenue, Mount Kisco, NY 10549, is described on the Village Tax Map as Section 80.64; Block 2; Lot 15; and is located on the east side of Lexington Avenue in the CL-1 Mixed Use Residential Commercial Zoning. Said appeal is being made pursuant to Village Law §7-712-b to obtain the following area variances:
Seven (7) variances from Village Code §110-19.1. C. (6) (b) [l] which, where the property abuts a residential or nonresidential lot, requires a minimum front buffer of twenty (20) feet. The applicable front yard buffer variances requested include:

Five (5) variances from Village Code §110-19.1 C. (8) (b) [2] which permits a maximum building coverage of 35%. The applicable maximum building coverage variances requested include:

Seven (7) variances from Village Code §110-19.1. C. (8) (b)[7][a] which requires a maximum building front setback of 30 feet. The applicable front yard setbacks variances requested include:

A variance of Village Code §110-19.1. C. (8) (b)[9] to allow seven (7) townhouse units in a row of buildings where the Code section prohibits more than six (6) townhouse units in a row of buildings. An additional variance of said Code section is required because, as the parking for the townhouse units is located in front, the proposed townhouse development does not allow for parking in the rear of the proposed townhouse buildings.
A variance of Village Code § 110 Attachment 1 Parking Facility Standards which requires multifamily properties to provide a 25 foot width of aisle space for parking at a 90 degree angle. The proposed aisle width is 22 feet and therefore a three (3) foot aisle width variance is required.
A variance of Village Code §110-30. D. (1) which requires that a compactor, dumpster and other large trash containers be located no closer to the property lines than is permitted for an accessory structure in such district. Village Code §110-31. G. (1) states that no accessory structure shall be located or project nearer to any street line or side lot line than does the principal structure on the lot. Lot 1 contains a proposed refuse enclosure that is located nearer to the front and side lot line than does the principal structure and therefore a variance is required.
A variance of Village Code §110-28. H. (4) (a) which prohibits parking, except in driveways, in the front and side yard distance setbacks required for the zoning district in which such building is located. The proposed development provides for parking in the front and side yard distance setbacks and therefore a variance is required.
