MORTGAGEE'S SALE OF REAL ESTATE
By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Joseph A. Muresco to Wells Fargo Home Mortgage, Inc., dated November 25, 2003 and recorded in Middlesex County (Southern District) Registry of Deeds in Book 41503, Page 593 (the “Mortgage”), as affected by a Loan Modification Agreement dated July 18, 2024, and recorded at said Registry of Deeds in Book 83118, Page 472 of which mortgage U.S. Bank National Association, as Trustee, successor in interest to Wachovia Bank, National Association, as Trustee for Banc of America Funding Corporation Series 2004-1 is the present holder by Assignment from Wells Fargo Bank, N.A., successor by merger to Wells Fargo Home Mortgage, Incorporated to U.S. Bank National Association, as Trustee, successor in interest to Wachovia Bank, National Association, as Trustee for Banc of America Funding Corporation Series 2004-1 dated April 24, 2012 and recorded at said Registry of Deeds in Book 58953, Page 466, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 4 Spring Street, Hopkinton, MA 01748 will be sold at a Public Auction at 4:00 PM on January 20, 2026, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
That certain lot or parcel of land, with any buildings and improvements thereon, located on the Northwesterly side of Spring Street, in the Town of Hopkinton, Middlesex County, Massachusetts, and being shown on a plan of land entitled: "Plan of Land in Hopkinton, Massachusetts" dated August 15, 1956 by Schofield Bros. Reg. Civil Engineers, which plan is recorded with the Middlesex South Registry of Deeds as Plan No. 2177 of 1956 in Plan Book 8881, Plan 50, bounded and described as follows:
Southeasterly by the northwesterly line of Spring Street, one hundred sixty (160) feet;
Northeasterly by land now or formerly of Leonard S. Wright et ux, one hundred eighty (180) feet;
Northwesterly by other land now or formerly of said Wright, one hundred sixty (160) feet; and Southwesterly by land now or formerly of said Wright, one hundred eighty (180) feet.
Subject to and with the benefit of any and/or all rights, restrictions, covenants and easements of record, insofar as the same may be in force and applicable.
For mortgagor’s title see deed recorded with the Middlesex County (Southern District) Registry of Deeds in Book 41503, Page 591.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee. The description for the premises contained in said mortgage shall control in the event of a typographical error in this publication.
