By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Darnet Creese and Alicia Mack to Meetinghouse Cooperative Bank, dated October 2, 2007 and recorded in Norfolk County Registry of Deeds in Book 25204, Page 478 (the “Mortgage”), as affected by a Loan Modification Agreement dated April 27, 2015, and recorded at said Registry of Deeds in Book 34449, Page 382, and further affected by a Loan Modification Agreement dated September 8, 2017, and recorded at said Registry of Deeds in Book 35522, Page 572 of which mortgage PHH Mortgage Corporation s/b/m Ocwen Loan Servicing, LLC is the present holder by Assignment from Meetinghouse Bank to Mortgage Electronic Registration Systems, Inc., its successors and/or assigns dated October 10, 2007 and recorded at said Registry of Deeds in Book 25264, Page 369, and Assignment from Mortgage Electronic Registration Systems, Inc. to GMAC Mortgage, LLC dated January 31, 2011 and recorded at said Registry of Deeds in Book 28584, Page 184, and Assignment from GMAC Mortgage, LLC to Ocwen Loan Servicing, LLC dated March 19, 2013 and recorded at said Registry of Deeds in Book 31211, Page 587, and Assignment from East Boston Savings Bank successor in interest to Meetinghouse Cooperative Bank to Mortgage Electronic Registration Systems, Inc., as mortgagee, its successors and assigns dated May 4, 2021 and recorded at said Registry of Deeds in Book 39378, Page 75, and Assignment from Mortgage Electronic Registration Systems, Inc., as mortgagee, its successors and assigns to GMAC Mortgage, LLC successor by merger to GMAC Mortgage Corporation dated July 1, 2021 and recorded at said Registry of Deeds in Book 39604, Page 295, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 333 Grove Street, Randolph, MA 02368 will be sold at a Public Auction at 1:00 PM on January 20, 2026, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
A certain parcel of land with the buildings thereon situate on Grove Street in Randolph, Norfolk County, Massachusetts and shown as Lot 3 on a plan entitled "Plan of Land in Randolph drawn for Woodlawn Realty, Inc." dated April 26, 1958 by Hayward-Hayward & Boynton, which plan is recorded with Norfolk Deeds in Book 3685 Page 143. Said Lot 3 is more particularly bounded and described according to said Plan, as follows:
SOUTHERLY: by Grove Street, as shown on said plan, seventy-six and 14/100 (76.14) feet;
WESTERLY: by Lot 2, as shown on said plan, one hundred sixty (160) feet;
NORTHERLY: by land of owners unknown, as shown on said plan, sixty-seven (67) feet; and
EASTERLY: by Lot 4, as shown on said plan, one hundred sixty (160) feet.
Containing 11,440 square feet of land according to said plan.
For Grantors' title, see deed from William G. Cappola and Lucia Cappola to Darnet Creese and Alicia Mack to be recorded herewith.
For mortgagor’s title see deed recorded with the Norfolk County Registry of Deeds in Book 25204, Page 476.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee.
