MORTGAGEE’S NOTICE OF SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain Mortgage given by Kevin M. Barry and Kristine Barry to Ameriquest Mortgage Company, dated July 29, 2004 and recorded with the Norfolk County Registry of Deeds at Book 21389, Page 272, subsequently assigned to Mortgage Electronic Registration Systems, Inc. by Ameriquest Mortgage Company by assignment recorded in said Norfolk County Registry of Deeds at Book 23321, Page 149, subsequently assigned to U.S. Bank National Association, not in its individual capacity but solely as indenture trustee, for the holders of the CIM Trust 2021-R2, Mortgage-Backed Notes, Series 2021-R2 by Mortgage Electronic Registration Systems, Inc. (“MERS”) as Mortgagee, its successors and assigns by assignment recorded in said Norfolk County Registry of Deeds at Book 41313, Page 539, subsequently assigned to U.S. Bank Trust Company, National Association, as Trustee, as successor-in-interest to U.S. Bank National Association, not in its individual capacity but solely as indenture trustee, for the holders of the CIM Trust 2021-R2, Mortgage-Backed Notes, Series 2021-R2 by U.S. Bank National Association, not in its individual capacity but solely as indenture trustee, for the holders of the CIM Trust 2021-R2, Mortgage-Backed Notes, Series 2021-R2 by assignment recorded in said Norfolk County Registry of Deeds at Book 41725, Page 172 for breach of the conditions of said Mortgage and for the purpose of foreclosing same will be sold at Public Auction at 3:00 PM on January 23, 2026 at 3 Hendricks Street, Avon, MA, all and singular the premises described in said Mortgage, to wit:
The land in Avon, in said County of Norfolk, with the buildings thereon, shown as Lot numbered 2 on a Plan entitled "Subdivision of Land in Avon, Mass., May 1, 1953, L.W. DeCelle & Sons, Surveyors," recorded with Norfolk County Registry of Deeds, Book 3177, Page 516, being more particularly bounded and described as follows:
Easterly by the westerly line of Hendricks Street, on three courses, the second being on curving line, measuring respectively, 52.28 feet, 38.36 feet, and 27.09 feet;
Southerly by Lot numbered 1 on said Plan, 70 feet;
Westerly by Lot numbered 2A on said Plan, 120 feet; and
Northerly by Lot numbered 12 on said Plan, 100 feet.
Containing, according to said Plan 8,200 square feet.
Also, another parcel of land in said Avon, with any buildings thereon shown as Lot numbered 2A on said Plan, being more particularly bounded and described as follows:
Easterly by Lot numbered 2 on said Plan, being the above-mentioned parcel 120 feet;
Southerly by land now or formerly of Mitchell, 70 feet, more or less;
Westerly by land now or formerly of Mitchell, 118 feet, more or less; and
Northerly by Lot numbered 12A on said Plan, 60 feet, more or less.
Subject to and with the benefit of restrictions and easements of record.
For title reference, see deed recorded with said Registry of Deeds in Book 21175, Page 407.
The premises are to be sold subject to and with the benefit of all easements, restrictions, encroachments, building and zoning laws, liens, unpaid taxes, tax titles, water bills, municipal liens and assessments, rights of tenants and parties in possession, and attorney’s fees and costs.
TERMS OF SALE:
A deposit of TEN THOUSAND DOLLARS AND 00 CENTS ($10,000.00) in the form of a certified check, bank treasurer’s check or money order will be required to be delivered at or before the time the bid is offered. The successful bidder will be required to execute a Foreclosure Sale Agreement immediately after the close of the bidding. The balance of the purchase price shall be paid within thirty (30) days from the sale date in the form of a certified check, bank treasurer’s check or other check satisfactory to Mortgagee’s attorney. The Mortgagee reserves the right to bid at the sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney. The description of the premises contained in said mortgage shall control in the event of an error in this publication. TIME WILL BE OF THE ESSENCE.
