Girouard Whereas a civil action seeking a declaratory judgment in a dispute concerning title to certain property in the Town of Gardner, Worcester County, Commonwealth of Massachusetts, known and numbered as 11 Yale Street (the "Property"), wherein the Plaintiff, Angelo David Liberatore, is seeking a Judgment declaring that the deed transferring title in the Property., with an incorrect grantor clause, was valid, and that title to the Property is currently in the Plaintiff's name, and is free and clear of any and all claims by the Unknown Heirs and Devisees of Jovide N. Girouard, and anyone claiming by, though, or under them. We hereby COMMAND YOU, if you intend to make any defense, that on or before February 6, 2026 (the "Return Date"), you cause your written answer or other pleading to be filed with the Clerk of this Court, at Worcester Superior Court, 225 Main Street, Worcester, MA 01608, with a copy sent to the Plaintiff's attorney, Peter W. Shanley, Hackett Feinberg, P.C., 155 Federal Street, Boston, MA 02110, and further that you defend against said suit according to law. If you fail to do so, judgment by default will be taken against you for the relief sought by the Plaintiff in the Verified Complaint. It appearing to this Court that actual service of the Complaint on the Defendants identified herein above cannot be or has not been made, and after diligent search, the Plaintiffs can find no such persons upon whom they can lawfully make service, it is ORDERED that notice of this suit be given to them by publishing this Summons and Order of Notice by Publication in The Gardner News, in Worcester County, Massachusetts, once a week for three consecutive weeks, with said publication to be completed at least 20 days before the Return Date set forth above.
