Notice of Pending Application for Proposed Dredging
Mark Pfaller, PO Box 541, Elkhart Lake, WI 53020 has applied to the Department of Natural Resources for dredging individual permit. The project is located on parcel 59018258541 near Elkhart Lake in SW 1/4, SE 1/4, Section 30 Township 16N, Range 21E located in Town of Rhine, Sheboygan County.
The applicant proposes to dredge 1,197 cubic yards of material from the bed of an unnamed navigable waterbody in a wetland. This waterbody is fed by runoff from the surrounding area and from adjacent wetlands and eventually flows into Elkhart Lake through an unnamed, non-navigable tributary. Per the applicant, the purpose of the project is to excavate and remove legacy phosphorus in sediment to mitigate nutrient loading to Elkhart Lake. Sediment removal will be accomplished via mechanical or hydraulic means. Mechanical dredging and scraping would utilize an excavator to remove sediment manually and place it in piles to dry out before hauling to a proper disposal location. Hydraulic dredging would utilize pumps and suction to remove sediment from the wetland in a slurry mixture. This project also includes a wetland restoration/conservation component. They will be creating a scrape that aims to enhance 0.35 acres of wetland and habitat restoration.
The Department is evaluating the project's impacts on the public interest, which includes fish and wildlife habitat, natural scenic beauty, water quality, recreation, and navigation, as well as whether the project will cause environmental pollution, and whether that project will result in a material injury to neighboring riparian landowners. The Department will review the proposal provided by the applicant and any information from public comments and the public informational hearing. The Department will determine whether the proposal complies with ss. 1.11, 30.20, 281.36, 30.208, Wis. Stats., and ch. NR 150, Wis. Adm. Code.
The Department has made a tentative determination that it will issue the permit for the proposed activity.

If you are requesting a public informational hearing, the request must be emailed, verbalized, or postmarked within 20 days after the date this notice is published on the Department's website. A request for hearing must include the docket number or applicant name and specify the issues that the party desires to be addressed at the informational hearing.
If no hearing is requested, the Department may issue its decision without a hearing. If a public informational hearing is held, comments must be postmarked no later than 10 days following the date on which the hearing is completed.
The final decision may be appealed as indicated in the decision document.
