MORTGAGEE'S SALE OF REAL ESTATE
By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Mark R. Benoit and Cheryl A. Benoit to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for United First Mortgage, Inc., its successors and assigns, dated November 12, 2002 and recorded in Worcester County (Worcester District) Registry of Deeds in Book 28059, Page 193 (the “Mortgage”) of which mortgage U.S. Bank National Association, as Indenture Trustee on behalf of and with respect to Barclays Mortgage Trust 2021-NPL1, Mortgage-Backed Securities, Series 2021-NPL1 is the present holder by Assignment from Mortgage Electronic Registration Systems, Inc. to Bank of America, N.A. successor by merger to BAC Home Loans Servicing, LP fka Countrywide Home Loans Servicing LP dated August 10, 2012 and recorded at said Registry of Deeds in Book 49461, Page 169, and Assignment from Bank of America, N.A. to Green Tree Servicing LLC dated May 17, 2013 and recorded at said Registry of Deeds in Book 50979, Page 377, and Assignment from Ditech Financial LLC f/k/a Green Tree Servicing LLC to New Residential Mortgage LLC dated February 13, 2020 and recorded at said Registry of Deeds in Book 61891, Page 288, and Assignment from New Residential Mortgage, LLC to NewRez LLC d/b/a Shellpoint Mortgage Servicing dated August 25, 2020 and recorded at said Registry of Deeds in Book 63877, Page 121, and Assignment from NewRez LLC f/k/a New Penn Financial LLC d/b/a Shellpoint Mortgage Servicing to U.S. Bank National Association, as Indenture Trustee on behalf of and with respect to Barclays Mortgage Trust 2021-NPL1, Mortgage-Backed Securities, Series 2021-NPL1 dated January 10, 2022 and recorded at said Registry of Deeds in Book 66920, Page 384, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 173 Orient Street, Worcester, MA 01604 will be sold at a Public Auction at 4:00 PM on January 28, 2026, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
Beginning at a point on the northerly sideline of Orient Street, said point being south 72 degrees 5' 45" West Eight-five (85) feet from the intersection of the westerly line of Villanova Street and the northerly line of Orient Street;
THENCE South 72 degrees 53' 45" West Eight-Five (85) feet by the northerly line of Orient Street to a point;
THENCE North 17 degrees 08' 15" West by Land of now or formerly Thomas and Marie Vincequere Eight-three (83) feet to a point;
THENCE North 72 degrees 53'45" East Eight-five (85) feet to a point;
THENCE South 17 degrees 08' 15" East Eighty-three (83) feet to the point of beginning.
This lot contains 7055 feet.
Containing to calculation 7,055 square feet of land and being delineated as Lot B on a plan entitled "Plan of Land I City of Worcester prepared by Villanova Realty Trust", dated January 17, 1986 and prepared for filing with the Worcester District Registry of Deeds in Plan Book 548, Plan 14, by Amen Esper, Jr., Registered Land Surveyor, Worcester Ma.
For mortgagor’s title see deed recorded with the Worcester County (Worcester District) Registry of Deeds in Book 21738, Page 2.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee. The description for the premises contained in said mortgage shall control in the event of a typographical error in this publication.
