NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE
Premises: 36 Courtland Street, Worcester, Massachusetts
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Edward Halitsky and Roxanne Halitsky to Mortgage Electronic Registration Systems, Inc. ("MERS"), as mortgagee, as nominee for Fairway Independent Mortgage Corporation its successors and assigns and now held by Fairway Independent Mortgage Corporation, said mortgage dated July 7, 2022, and recorded in the Worcester County (Worcester District) Registry of Deeds in Book 67873, Page 351, as affected by an Assignment of Mortgage dated March 10, 2023, and recorded in the Worcester County (Worcester District) Registry of Deeds in Book 68908, Page 185, as affected by an Assignment of Mortgage dated December 1, 2023, and recorded in the Worcester County (Worcester District) Registry of Deeds in Book 69966, Page 1, of which mortgage the undersigned is the present holder, for breach of the conditions in said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on January 28, 2026 at 10:00 AM Local Time upon the premises, all and singular the premises described in said mortgage, to wit:
The land in Worcester, County of Worcester, Massachusetts on the southwesterly side of Courtland Street and being Lot No. 2, Block D as shown on plan of Courland Gardens made by H.L. Robinson C.E. and recorded with the Worcester District Registry of Deeds in Plan Book 49, Plan 8, and further described as follows:
TRACT I:
Beginning at the most easterly corner of the premises to be conveyed at the most northerly corner of Lot No. 3 Block D on said plan, said point being one hundred eighty and nineteen hundredths (180.19) feet N. 70° 40' W. on the southwesterly line of Courtland Street from the intersection of said line and the northerly line of Geneva Street;
Thence N. 70° 40' W. by said Courtland Street, fifty (50) feet to Lot No. 1 Block D on said plan;
Thence S. 19° 20' W. by said Lot No. 1, one hundred (100) feet to Lot No. 5 Block D on said plan;
Thence S. 70°40' E. by said Lot No. 5, fifty (50) feet to said Lot No. 3;
Thence N. 19°20' E. by said Lot No. 3, one hundred (100) feet to the point of beginning.
TRACT II:
About 4,852 square feet of land situated on the northerly side of Geneva Street and adjoining estate now or formerly of Mortgage Investment Trust, Trustees of, being designated on Assessor's Plan as Lot No. 5, Page No. 4 and Book No. 14 and now or formerly owned by Trustees of Mortgage Investment Trust.
Excepting form Tract II so much of the premises as was conveyed to John R. Hult et ux by deed of Samuel Clark et ux dated November 17, 1949 and recorded with said Deeds, Book 3223, Page 64.
The description of the property contained in the mortgage shall control in the event of a typographical error in this publication.
For Mortgagor's Title see deed dated June 30, 2022, and recorded in the Worcester County (Worcester District) Registry of Deeds in Book 67873, Page 347.
TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described.
TEN THOUSAND ($10,000.00) Dollars of the purchase price must be paid by a certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid by a certified check, bank treasurer's or cashier's check within forty-five (45) days after the date of sale.
