NOTICE OF FORECLOSURE SALE
Mortgagee’s Sale of Real Estate
580 GAR Highway, Swansea, MA 02777
By virtue and in execution of the Power of Sale contained in a certain mortgage given by The Barn T & T, LLC to Baycoast Bank dated December 16, 2021 and recorded with the Bristol Fall River Registry of Deeds on December 17, 2021 in Book 10855 at Page 271, of which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at 12:00 o’clock, p.m. on the 30th day of January, 2026, at 580 GAR Highway, Swansea, Bristol County, MA 02777, all and singular the premises described in said mortgage,
To wit:
A certain tract or parcel of land with the buildings and improvements thereon, if any, situated in the Town of Swansea, County of Bristol, Commonwealth of Massachusetts, bounded and described as follows:
Beginning at the northwest corner of the land herein described at a point formed by the intersection of the southerly line of the Grand Army Highway with the easterly line of a private way sometimes known as Sears Road;
Thence Easterly in line of said Grand Army Highway, two hundred (200) feet to land now or formerly of Ina M. Delaney;
Thence Southerly in line of last-named land, one hundred fifty (150) feet to other land now or formerly of said Ina M. Delaney;
Thence Westerly in line of last-named land, two hundred (200) feet to the said line of Sears Road; and
Thence Northerly in line of said Sears Road, one hundred fifty (150) feet to the said southerly line of Grand Army Highway and the point of beginning.
Containing 30,000 square feet, more or less.
Being the same premises conveyed to The Barn T & T, LLC by Deed of GAR Swansea Real Estate LLC, a Massachusetts limited liability company, dated June 29, 2018 and recorded with the Bristol County (Fall River District) Registry of Deeds in Book 9543, Page 303.
Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens, and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens, or encumbrances is made in the deed.
The premises are also sold subject to the right of redemption of the United States of America.
Terms of Sale:
1. Successful bidder must furnish a deposit in the amount of TWENTY THOUSAND DOLLARS ($20,000.00) in cash or certified bank check at the time and place of sale;
2. Remaining balance to be paid at closing;
3. Closing to occur on or before the 30th day after sale;
4. Minimum successful bid in an amount no less than $750,000;
5. Subject to all encumbrances, prior liens and such matters which may constitute valid liens or encumbrances after sale;
6. Foreclosure deed to be delivered to purchaser for recording upon full receipt of the purchase price;
7. Description of the premises set forth in the mortgage controls in the event of any error in the Notice of Sale;
8. Purchaser responsible for all closing costs, recording costs, deed stamps, accrued or past-due property taxes, etc.;
9. In the event of default by highest bidder, second highest bidder may purchase provided deposit is paid within five (5) days of notice, otherwise a new auction sale will be conducted;
