NOTICE OF SALE
NOTICE IS HEREBY GIVEN that on March 18, 2026, at the hour of 10:00 AM, the undersigned Special Master, or his designee, will, at the front entrance of the Dona Ana County Courthouse, at 201 West Picacho, Las Cruces, New Mexico 88005, sell all of the rights, title, and interests of the above-named Defendant, in and to the hereinafter described real property to the highest bidder for cash. The property to be sold is located at 9514 El Centro Blvd, Las Cruces, New Mexico 88012, and is more particularly described as follows:
A tract of land situate West of Organ, Dona Ana County, New Mexico, located in Section 4, T.22S., R.3E., N.M.P.M. of the U.S.G.L.O. Surveys, and being more particularly described as follows, to wit:
BEGINNING at a spotter found on the intersection of the centerline of El Centro Boulevard and the centerline of Fox Road for the Northwest corner of this tract: WHENCE the Northwest corner of Section 4, T.22S.,R .3E., N.M.P.M. of the U.S.G.L.O. Surveys, bears N.89°48'16"W., 1324.48 feet;
THENCE, from the point of beginning, along the centerline of El Centro Boulevard, S.89°48'16"E., a distance of 331.12 feet to a spotter found for the Northeast corner of this tract;
THENCE, leaving the centerline of El Centro Boulevard, S.00°54'23"E., at 30.00 feet a 1/2" iron rod found on the Southerly line of a 60.00 foot wide road easement (known as El Centro Boulevard, and at 358.05 feet to a 1/2" iron rod found for the Southeast corner of this tract;
THENCE N.89°42'26"W., at 316.08 feet a 1/2" iron rod found on the Easterly line of a 30.00 foot wide road easement, known as Fox Road, and at 331.08 feet a 1/2" iron rod found for on the centerline of Fox Road for the Southwest corner of this tract;
THENCE, along the centerline of Fox Road, N.00°54'51"W., a distance of 357.49 feet to the point of beginning, enclosing 2.7188 acres of land, more or less. Subject to a 30.00 foot wide road easement parallel and immediately adjacent to the Northerly boundary, and a 15.00 foot wide road easement parallel and immediately adjacent to the Westerly boundary. including any improvements, fixtures, and attachments, such as, but not limited to, mobile homes (hereinafter the "Property"). If there is a conflict between the legal description and the street address, the legal description shall control.
The foregoing sale will be made to satisfy a foreclosure judgment rendered by this Court in the above-entitled and numbered cause on December 30, 2025, being an action to foreclose a mortgage on the Property. Plaintiff's judgment is in the amount of $37,224.99, and the same bears interest at the rate of 6.9700% per annum, accruing at the rate of $7.11 per diem. The Court reserves entry of final judgment against Defendant, Carley Pogue aka Carley J. Pogue aka C.J. Pogue, for the amount due after foreclosure sale, including interest, costs, and fees as may be assessed by the Court. Plaintiff has the right to bid at the foregoing sale in an amount equal to its judgment, and to submit its bid either verbally or in writing. Plaintiff may apply all or any part of its judgment to the purchase price in lieu of cash.
In accordance with the Court's decree, the proceeds of sale are to be applied first to the costs of sale, including the Special Master's fees, and then to satisfy the above-described judgment, including interest, with any remaining balance to be paid unto the registry of the Court in order to satisfy any future adjudication of priority lienholders.
NOTICE IS FURTHER GIVEN that in the event that the subject Note and Mortgage is not sooner paid off or reinstated, the undersigned Special Master will, as set forth above, offer for sale and sell the Property to the highest bidder for cash or equivalent, for the purpose of satisfying, in the adjudged order of priorities, the judgment and decree of foreclosure described herein, together with any additional costs and attorney's fees, including the costs of advertisement and publication for the foregoing sale, and, reasonable receiver and Special Master's fees in an amount to be fixed by the Court. The amount of the judgment due is $37,224.99, plus interest to and including date of sale in the amount of $974.07, for a total judgment of $38,199.06.
The foregoing sale may be postponed and rescheduled at the discretion of the Special Master, and is subject to all taxes, utility liens and other restrictions and easements of record, and subject to a one (1) month right of redemption held by the Defendants upon entry of an order approving sale, and subject to the entry of an order of the Court approving the terms and conditions of sale.
