Lawson to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Countrywide Home Loans, Inc., its successors and assigns, dated October 26, 2005 and recorded in Plymouth County Registry of Deeds in Book 31618, Page 237 (the “Mortgage”), as affected by a Loan Modification Agreement dated December 28, 2018, and recorded at said Registry of Deeds in Book 50742, Page 263 of which mortgage U.S. Bank Trust National Association, not in its individual capacity but solely as owner trustee for RCF 2 Acquisition Trust is the present holder by Assignment from Mortgage Electronic Registration Systems, Inc. to Countrywide Home Loans Servicing LP dated January 20, 2009 and recorded at said Registry of Deeds in Book 36721, Page 120, and Assignment from Mortgage Electronic Registration Systems, Inc. to BAC Home Loans Servicing, LP FKA Countrywide Home Loans Servicing, LP dated August 8, 2011 and recorded at said Registry of Deeds in Book 40209, Page 204, and Assignment from Bank of America, N.A. to Federal National Mortgage Association dated October 6, 2012 and recorded at said Registry of Deeds in Book 42104, Page 320, and Assignment from Bank of America, N.A. successor by merger to BAC Home Loans Servicing LP, FKA Countrywide Home Loans Servicing LP. to Federal National Mortgage Association dated October 25, 2012 and recorded at said Registry of Deeds in Book 42212, Page 198, and Assignment from Federal National Mortgage Association to Wilmington Savings Fund Society, FSB, DBA Christiana Trust, not individually but as trustee for Pretium Mortgage Acquisition Trust dated April 7, 2016 and recorded at said Registry of Deeds in Book 46841, Page 242, and Assignment from Wilmington Savings Fund Society, FSB, DBA Christiana Trust, not individually but as trustee for Pretium Mortgage Acquisition Trust to NWL Company, LLC dated September 27, 2019 and recorded at said Registry of Deeds in Book 51930, Page 68, and Assignment from NWL Company, LLC to U.S. Bank Trust National Association, not in its individual capacity but solely as owner trustee for RCF 2 Acquisition Trust dated May 11, 2021 and recorded at said Registry of Deeds in Book 55071, Page 42, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 5 Chilton Avenue, Kingston, MA 02364 will be sold at a Public Auction at 10:00 AM on February 3, 2026, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
A certain parcel of land, with the buildings thereon, situated in that part of Kingston, Plymouth County, Massachusetts, known as Rocky Nook, and being Lot #81 on the Easterly side of Chilton Avenue, a private way as shown on a plan of lots of Rock Nook Park situated on Kingston Bay, and plan being duly recorded with the Plymouth County Deeds, Plan 1, Page 259. Said lot measures 50' x 100' as shown on said plan.
For mortgagor’s title see deed recorded with the Plymouth County Registry of Deeds in Book 13796, Page 229.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee. The description for the premises contained in said mortgage shall control in the event of a typographical error in this publication.
