FORECLOSURE NOTICE
Notice of foreclosure by advertisement. Notice is given under Section 3212 of the Revised Judicature Act of 1961, 1961 PA 236, MCL 600.3212, that the following mortgage will be foreclosed by a sale of the mortgaged premises, or some part of them, at a public auction sale to the highest bidder for cash or cashier’s check at the place of holding the circuit court in Cheboygan County, starting promptly at 11:00 A.M., on February 20, 2026. The amount due on the mortgage may be greater on the day of the sale. Placing the highest bid at the sale does not automatically entitle the purchaser to free and clear ownership of the property. A potential purchaser is encouraged to contact the county register of deeds office or a title insurance company, either of which may charge a fee for this information. Attention homeowner: If you are a military service member on active duty, if your period of active duty has concluded less than 90 days ago, or if you have been ordered to active duty, please contact the attorney for the party foreclosing the mortgage at the telephone number stated in this notice. Marvin K. Smith, a single man, (“Mortgagor”), gave a mortgage to Straits Area Federal Credit Union, (“Mortgagee”), dated May 22, 2020, and recorded on June 1, 2020, in Liber 1413, on Page 635, Cheboygan County Records, Michigan. On the date of this notice, there is claimed to be due the principal of Twenty-Nine Thousand Twenty-Six Dollars and 96/100 Dollars ($29,026.96) plus accrued interest at 5.00% per annum. Under the power of sale contained in said mortgage and the statute in such case made and provided, notice is hereby given that said mortgage will be foreclosed by a sale of the mortgaged premises, or some part of them, at the place of holding in the circuit court within Cheboygan County, Michigan @ 11:00 A.M. on Friday, February 20, 2026. Said premises are situated in the Township of Benton, County of Cheboygan, State of Michigan, and are described as: A parcel of land situated in the Northeast 1/4 of the Northeast 1/4 of Section 34, Town 37 North, Range 1 West and described as follows: Beginning at the Northeast corner of said Section 34; Town 37 North, Range 1 West; thence South on Section line to the County Highway Right-of-Way line 33.00 feet; thence North 85 degrees 12 minutes West along County Highway Right-of-Way line 361.35 feet to the point of beginning of this description; thence North 85 degrees 12 minutes West along said Right-of-way line 101.80 feet; thence South 57 degrees 03 minutes East along the Black River Road Right-of-Way line 94.34 feet; thence North 27 degrees 27 minutes East 48.12 feet to the place of beginning. Commonly: 6978 South River Rd., Cheboygan, MI 49721—Tax Id #104-034-200-003-00 The redemption period shall be six months from the date of such sale unless determined abandoned in accordance with MCLA 600.3241a, in which case the redemption period shall be 30 days from the date of such sale. If the property is sold at a foreclosure sale, under Section 600.3278 of the Michigan Compiled Laws, the Mortgagor will be held responsible to the person who buys the property at the mortgage foreclosure or to the mortgage holder for damaging the property during the redemption period.
