NOTICE INVITING BIDS
NOTICE IS HEREBY GIVEN that the City of Hesperia will receive sealed bids on or before 10:00 a.m. on February 12, 2026 via the Public Purchase bidding platform for the construction of the HWY 395 Water Relocation Project, ENG-2026-01.
Bids will be opened and publicly read immediately thereafter at City Hall located at 9700 Seventh Avenue in the Joshua Conference Room.
PROJECT DESCRIPTION: The work necessary for the completion of this Contract generally consists of the following, including but not limited to:
• Construction of 8-inch and 12-inch diameter water main within and along HWY 395, including trenching and trench repair in accordance with Caltrans and City of Hesperia Standards and Specifications, excavation, backfill and compaction, fittings, bends, services installation and service reconnections, valves, fire hydrants, blow-off hydrants, combination air-vacuum/air-release valves, pipe sleeving, and all appurtenant facilities;
• Testing and commissioning of the newly installed water main, including connections to the existing water system;
• Maintain continuous water service to existing customers during construction, per contract documents;
• Jack-and-bore construction of the proposed pipeline crossing beneath HWY 395, including installation of a 24-inch steel casing and carrier pipe;
• Abandonment of existing water main, valves, all appurtenant facilities including slurry filling of to be abandoned water mains;
• Removal, handling, and proper disposal of hazardous materials, including existing asbestos-cement (AC) pipe;
• Traffic control preparation and implementation, in accordance with approved encroachment permit/s; and
• Coordination with Caltrans and other agencies.
Please note that field conditions may necessitate adjustments to the proposed scope during construction, and the City reserves the right to modify the work as needed to address unforeseen site-specific conditions.
The Engineer’s Estimate of Probable Costs is $2,366,255.
Questions or clarifications concerning the scope of work for each component should be submitted prior to the deadline specified in the Bid Package.
The plans and specifications for this project are available for download online through the Public Purchase website which can be accessed through the City of Hesperia website at https://www.cityofhesperia.us/109/Engineering or via the Public Purchase website directly at www.publicpurchase.com. Bids shall be submitted in conformance with the Contract Documents and Specifications as provided by the Engineering Department of the City of Hesperia. Bids must be entered on the Public Purchase form. The additional forms labeled Bid Submittal Package shall be inclusive with the bid along with any additional forms specified in the Instructions to Bidders. Bids and accompanying documents must be submitted online in Public Purchase. Hard copies of the bid will not be accepted.

DISADVANTAGED BUSINESS ENTERPRISE: Though no Disadvantaged Business Enterprise (DBE) goal is set for this Project, the City strongly encourages participation from small and Disadvantaged Business Enterprises.
PUBLIC WORKS CONTRACTOR AND SUBCONTRACTOR REGISTRATION: Pursuant to California Labor Code Division 2, Part 7, Chapter 1, Article 2, a contractor or subcontractor shall not be qualified to bid on, be listed in a bid proposal, or engage in the performance of any contract for public work with the City of Hesperia, as defined in said chapter, unless currently registered with the California Department of Industrial Relations and is qualified to perform public work pursuant to Labor Code § 1725.5 [with limited exceptions from this requirement for bid purposes only under Labor Code § 1771.1(a)]. It is not a violation of this section for an unregistered contractor to submit a bid that is authorized by § 7029.1 of the Business and Professions Code or by §§ 10164 or 20103.5 of the Public Contract Code, provided the contractor is registered to perform public work at the time the contract is awarded.
All Contractors and Subcontractors performing work on this project shall be required to furnish electronic certified payroll records directly to the Labor Commissioner (i.e., California Department of Industrial Relations - Division of Labor Standards Enforcement). The awarded Contractor shall post jobsite notices as prescribed by regulations.
All Bidders and their subcontractors (that are listed on – List of Proposed Subcontractors or Sub-Tier Contractors) shall provide an extract from the Public Works Contractor Registration web site with their submitted bid providing evidence of active registration with the Labor Commissioner.
This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations.
NOTICE IS HEREBY GIVEN that under the provisions of California Labor Code, Division 2, Part 7, Chapter 1, Articles 1 and 2, the contractor and any subcontractor under the contractor is required to pay not less than the general prevailing rate of per diem wages to all workmen employed in the performance of work under this project for work of a similar character in the locality in which the public work is performed, including the general prevailing rate of per diem wages for holiday and overtime work. Pursuant to § 1773 of the Labor Code, the Director of the California Department of Industrial Relations (DIR) has determined such general prevailing rates of per diem wages. The same
are on file at the Engineering Department of the City of Hesperia, 9700 Seventh Avenue, Hesperia, California, and are available to any interested party upon request; or may be obtained online from the DIR website at http://www.dir.ca.gov. The contractor shall cause a copy of said determinations to be posted at the job site. The contractor shall be subject to the penalty forfeiture provisions of the Labor Code for violations by the contractor or any subcontractor under him. Future effective general prevailing wage rates, which have been predetermined and are on file with the California Department of Industrial Relations are referenced but not printed in the general prevailing wage rates.
BIDDERS MUST SUBMIT, along with their bid - cash, a cashier’s check, a certified check, or a bidder’s bond, payable to the City of Hesperia in an amount equal to at least ten percent (10%) of the bid, as a guarantee that the Bidder will enter into the contract if the same is awarded to the successful bidder, and in event of failure to enter into such contract said cash, cashier’s check, certified check, or bond shall become the property of the City of Hesperia. If the City of Hesperia awards the contract to the next lowest Bidder, the amount of the lowest Bidder’s security shall be applied to the difference between the low bid and the second lowest bid, and the surplus, if any, shall be returned to the lowest Bidder.
The successful Bidder shall be required to post a Performance Bond in the amount of one hundred percent (100%) of the contract price and a Payment Bond (Labor and Materials Bond) equal to one hundred percent (100%) of the contract price. Sureties shall meet all the State of California bonding requirements in accordance with the Code of Civil Procedure (§ 995.120) and be admitted by the State of California.
Except as required by California Public Contract Code § 20103.5 - Federal Funded Projects, no bid will be considered from a contractor who is not licensed at the time of bid opening as a Class “A”: General Engineering Contractor.
The contractor may, upon request and at the sole expense of the contractor, substitute authorized securities in lieu of monies withheld (performance retention) by the City.
The successful bidder will be required to enter into a contract satisfactory to the City of Hesperia. The City reserves the right to reject any or all bids or any part(s) thereof, to waive any irregularities or informalities in any bid or in the bid process, and to make a contract award in the best interest of the City.
If a contract is awarded, the contractor shall comply with all applicable laws and regulations whether or not listed in this notice or the Contract Documents and Specifications.
