ORDINANCE NO. 2025-O-01
NOTICE IS HEREBY GIVEN that the Village Board of the Village of Cleveland, Manitowoc County, Wisconsin, adopted Ordinance No. 2025-O-01 on April 15, 2025, repealing and recreating Title 8, Chapter 4 of the Village Code relating to abandoned and junked vehicles. THE ORDINANCE REGULATES motor vehicles, trailers, semitrailers, and mobile homes that are abandoned, unlicensed, junked, wrecked, inoperable, or unattended within the Village. Such vehicles are declared a public nuisance when, among other circumstances, they are left unattended on public or private property for extended periods; stored in the open while disassembled, unlicensed, or inoperable after required notice; parked on public property beyond posted or noticed time limits; left without the permission of the property owner; or remain unclaimed following removal or notice. THE ORDINANCE ESTABLISHES notice requirements to vehicle owners, property owners, and lienholders, including mailed notice of the Village's intent to deem a vehicle abandoned, the right to avoid removal, and the right to an informal hearing before the Police Chief or designee. It authorizes the Police Chief or a contracted towing service to remove and impound abandoned vehicles and provides standards for storage, impoundment, and early disposal when towing and storage costs exceed the vehicle's value. THE ORDINANCE PROVIDES procedures for reclaiming impounded vehicles upon payment of accrued towing, storage, and administrative costs and establishes minimum holding periods before sale or disposal. Unclaimed vehicles may be sold at public auction or by sealed bid, privately sold, or junked, with notice of sale provided and proceeds applied to Village costs. Vehicles impounded as evidence or held pending court proceedings are also subject to storage costs once notice of release is given. LIMITED EXCEPTIONS are provided for licensed auto salvage yards, certain automobile sales and repair businesses operating under defined conditions, and vehicles located on private property out of ordinary public view or otherwise designated as not abandoned by authorized officials. Any person who abandons a vehicle in violation of the ordinance is subject to a forfeiture of not less than $250, plus costs of prosecution. The ordinance assigns financial responsibility for abandonment, towing, storage, and disposal to vehicle owners and allows recovery of unreimbursed costs through civil action. THE ORDINANCE TAKES EFFECT upon adoption and publication. A COMPLETE COPY of Ordinance No. 2025-O-01 is on file and available for public inspection at the Village Clerk's office, 1150 W.
