JUDGMENT ENTRY
This matter came before the Court on its own motion.
Pursuant to R.C. 2109.24, the Court may remove a fiduciary for failure to file an account as prescribed in R.C. 2109.301. In addition, a fiduciary may be removed by the Court for habitual drunkenness, neglect of duty, incompetency, or fraudulent conduct after giving the fiduciary not less than ten days’ notice. R.C. 2109.24.
The Court finds that William Sharrard Jr. was appointed the fiduciary in the above-referenced estates on December 27, 2021 (Case Number 241722) and January 13, 2023 (Case Numbers 244969, 244971, and 244970). On April 23, 2025, the Court ordered Fiduciary to file a Final Account. The Final Account remains delinquent in this matter.
Additionally, the Court finds that Fiduciary failed to appear for a Status Conference on November 19, 2025. Attorney Mills appeared for the hearing and stated that in July 2025, Fiduciary had cashed two unclaimed funds checks in the amounts of $20,879.78 and $14,108.46, had failed to deposit those funds into the estate bank account, and had closed the estate bank account without her knowledge or the Court’s approval. She stated that Fiduciary has also failed to address the payment of her attorney fees and has failed to pay for a certain storage unit related to these estates. She reported being unable to get in contact with Fiduciary since at least July of 2025.
In response, the Court issued a Citation to Appear and Order to Show Cause to both Fiduciary and his wife, Tiffany Sharrard, that was sent by certified mail to six address which were believed to be owned by or related to Fiduciary and/or his wife. Four of the certified mailings were returned as addressee unknown, the notice addressed to Fiduciary’s last known place of employment was accepted by a representative of the employer, and the notice sent to the Arrow Road address was returned to the Court as unclaimed. Neither Fiduciary nor Tiffany Sharrard appeared at the January 6, 2026 Show Cause Hearing. Attorney Mills appeared at that hearing and reported that she has had no further contact with Fiduciary or Tiffany Sharrard.
On January 7, 2026, the Stark County Probate Court Bailiff attempted to personally serve Fiduciary and Tiffany Sharrard a second Citation to Appear and Order to Show Cause. By affidavit dated January 12, 2026, the Bailiff attests that, despite due diligence, she was unable to ascertain Fiduciary and Tiffany Sharrard’s current address and was unable to personally serve them.
It is hereby ORDERED that this matter shall be set for a Fiduciary Removal Hearing on February 18, 2026 at 1:30 p.m.
